Query on ancestral property partition after father death

Hello Sir Thank you in advance for your advise. My grandfather passed away in 2006 and he had 5 children and my mother is one among them.My grandpa had ancestral property.My mother and her brothers had discussed and agreed to settle it amicably by hiring local lawyer.Since my mother stays far from village she had informed her brothers to hire local lawyer for documentation ,property division and settlement process and agreed to share the cost.Recently we came to know that the entire property is being transferred in elder brother name and upon questioning regarding same we got reply like this is the legal procedure followed. After the death of father/mother(legal owner) first the property would be transferred to eldest one(son/daughter) thereafter it will be partitioned among other legal heirs.... I would like to know 1.Is the procedure mentioned above is legally correct? 2.What action i can take if its not correct and my uncle is planning to cheat? 3.As far as i know the ancestral property cannot be divided or possesed untill all legal heirs agree and give their consent.Here its being transformed without my mother's involvement or consent..Is this correct? Please advise and do the needful.
