Special Leave

My father was employed in Northern Coalfields limited expired on 11.02.2016 due to lung cancer. He was referred by the company for his treatment to Mumbai Tata Memorial Hospital and he was there for more than six months for his treatment. Now during his settlement from his Company (Northern Coalfields Limited) we requested for special leave amount which was rejected on the ground that there was no application submitted by my father for the same though it was submitted which was later lost by one of the staff negligence. As per NCWA IX Employees suffering from Heart disease, TB, Cancer, Leprosy, Paralysis, Renal diseases, HIV and Brain disorders shall be granted special leave @ 50% of Basic pay VDA & SDA up to 6(six) months during the tenure of service period on the basis of recommendations of the Company Medical Officer or any other hospital to which the cases may be referred for treatment by the Management. And referred hospital has given in writhing that my father was suffering lungs cancer and treatment duration will be six months. Now my question is on this ground can I demand for special leave compensation or not?
