Unless a specific stay has been ordered by the court, which could be the District Court , can civic bodies will take action in accordance with law. I am facing the same issue , as due to encroachment in front of my shop made by the regular encroachers I had lodge a case in the civil court for granting permanent injunction for restraining the defendants to make illegal encroachment in front of my shop on Municipal Street but I would also like to mention here that the court does not issue any stay order in this regard , but whenever I have made the representation to the Commissioner Municipal Corp for the removal of the encroachment from the Municipal street they always made the contentions that the suit for illegal encroachment is pending in the court , so they can not take any action in this regard . Please provide any authority in this regard that the civic bodies will take action in accordance with law in the sub judice matter if court does not issue any stay order or status quo.
