Dear Sir, Hope you are doing well. I am working in a private company since Oct 2013 on yearly contract basis. In the initial contract, signed in Oct 2013, they mentioned below clause and the said agreement was signed by me. "At no stage during the subsistence of this Agreement, will the consultant deem in anyway to be an employee of the Company. Should Department of Labour or any other regulatory authority rule that the consultant is an employee of the Company, the consultant agrees to indemnify the Company in respect of such fines, penalties etc that may be levied on the Company arising from the said ruling." Followed by every year renewal with revised salary and terms will be same as per the original agreement signed. Now as per the Maternity Leave Act, 1961, should I be eligible for Maternity leave for 6 Months with Pay? As on asking about my rights for maternity company said, "The maternity policy of (Company Name) covers only the permanent employees. The individuals who are on consulting contracts have to take approval of reporting manager for the time period. However, the absence will be treated as Loss of Pay."
