Can surety be prosecuted for accused'd non appearance in Court?

I had a commercial vehicle which i used to run with OLA/UBER in bangalore. I had hired the driver who used to run my car. Once the driver met with with one accident and he injured one lady little. Traffic Police caught the driver and my car after that. After couple of hours, driver managed to flew from the police. Almost after 2-3 days of the incident I was informed about it. when i inquired with police to release the vehicle by paying penalty, they told me to produce the driver otherwise they won't release the car. I had even got the release paper from RTO, but police didn't release the vehicle. Finally somehow i had to search the driver and find him to come to police station. They released the vehicle then. they got me signed probably for the bail of the driver also. Also there was driver's brother as well who signed there. Police told to pay some amount as well and told that after this we need to go to court on the given dates since this case is sent to court already. Now after that i had got a notice from insurance company saying that a claimant is claiming accident history and i have not informed. SO i hired a lawyer and i guess this was closed after 2-3 hearings. Now almost after a year, traffic police is calling me for past 2 weeks inquiring about the driver and saying that i should produce him to the court since he has not gone to court for closure till date. I have even sold the car. I currently have no contact with driver. I gave the number and address which i had with me to police.I even called up the driver and told the same but he doesn't seem to be in Bangalore and in no mood to come to the court. Police is saying the i will be served notice and they would come to take me to court in case if he doesn't appear on the date. or seize the car.I don't know what is the right step to be taken.
