Legal process to sell an under construction home with a homeloan

Background: ========== * I purchase a home in North Bangalore during 2013 which is almost ready for possession in next few months. * I have the copy of registered "Agreement to Sell" as well as "Construction Agreement". * I have a home loan from ICICI on this home. * I still have some outstanding dues to the builder based on builder's completion of next steps i.e. OC and possession etc * Property is not yet registered. * Builder recently informed me that I need to pay the TDS (to the govt i guess) on the payments made to the builder so far. No TDS paid so far. I plan to do the right thing (i.e. pay TDS if thats my responsibility). * I would like to sell this home ASAP. Couple of questions: =============== 1. Given that i have not yet taken posession, have some outstanding dues to builder, have a home loan, have outstanding TDS, what is the legal process to sell the home before taking possession from the builder? 2. What is the best way for me to sell this home without much hassle for me as well as the new buyer? 3. Is there a way to save on re-sale costs while i sell my property? 4. With the recent introduction of GST, what is the best way to proceed with the sale of the home - from a legal as well as financial/tax perspective? Thanks in advance!
