Selection for LPG Distributorship

The relevant Guidelines for Selection of LPG Distributors stipulate, inter alia, applicant should be an Indian Citizen and Resident of India as on the date of application. Thought the term 'Resident of India' used herein, has not been defined anywhere in the relevant Brochure, but the criteria in question has also been stipulated for selection of Retail Outlet Dealership and therein it reads that the applicant should be Resident of India as on the date of application, as per the definition of the same as provided in the Income Tax Act, 1961. Further, an applicant owning, with clear ownership title suitable Land for LPG Godown / LPG Godown shall be awarded 25 Marks under selection parameters. And no addition/alteration/modification shall be permitted after submission of application. Kindly provide whether an applicant who as per IT Act was not a Resident of India as on the date of application, is eligible for selection or not ? Kindly provide whether the Judgment of Hon'ble Supreme Court in the case of 'Bhagwan Dass Abroal & Ors' wherein the Hon'ble Court adjudged on the eligibility criteria prescribed by way 'Resident of Kangra District', applies herein or not ? Kindly provide whether an applicant who acquires violating the provisions of the Foreign Exchange Management Act, 1999, agricultural land for LPG Godown, is eligible to get awarded 25 Marks or not ? Kindly provide, lastly, whether the applicant who acquired the agricultural land for LPG Godown contravening the FEMA, 1999 provisions, and who goes subsequent to the selection, for Compounding of the Contraventions thus made, is eligible for retention of 25 Marks already awarded or not ?
