Co operative housing society maintenance

I stay in a complex/apartment consists of three towers. Two towers consists of 3650 sq.ft per flat comprising 20 flats per tower (in total 40 flats in 2 tower) & third tower has 2350 sq.ft per flat comprising 18 flats. There is a difference of opinion among flats holders to pay maintenance charges. Irrespective of any expenses, 2350 sq. ft flat holders wants to pay maintenance on sq. ft basis whereas 3650 sq.ft flat owners wants maintenance to be paid equally among all 58 flats owners. As this is new building, association/registered society is yet not formed & builder too not willing/initiating in formation of society. Differences on ground of maintenance paying in flat holders is increasing day by day which is disturbing the facilities available. In normal practice in Surat, where there is huge difference in sq.ft (3650-2350) maintenance is paid on sq.ft basis but 3650 sq.ft flat holders are not agreeing on this. Big flat holders(3650 sq.ft) are all together 40 in number whereas 2350 sq.ft flats are just 18, so in majority they may always win to pass any law. Is there any guidelines or law to follow fixation of maintenance charges in residential building?
