Appeal under cca rules

I have been imposed the punishment of compulsory retirement from 24/05/15. I had submitted an application for granting me the pensionary benefits. Thereby, I had preferred an appeal against the penalty within the stipulated time limit. The appellate authority had kept pending my appeal until recent. I had intimated the appellate authority that I will approach the Lokayukta if my appeal is not disposed of within a reasonable period of time. Thus, the authority has dismissed my appeal stating that since I had made an application for the sanction of pensionary benefits it is tantamount to accepting the punishment. In fact, a retired officer was appointed as inquiring authority against me. The Rule 11(2) of the Karnataka Civil Services (CCA) Rules, 1957 do not provide for appointing a retired officer as Inquiring Officer. However, I was unaware of this legal position at the time of preferring the appeal. As such, I had submitted an interlocutory appeal bringing this aspect to the notice of the appellate authority. Despite, the same is rejected on the sole ground of having requested for the grant of pensionary benefits. Therefore, I may please be enlighten about the remedy to be availed by me.
