I commenced my cadre service as lecturer in education on [deleted].But the government did not pay ugc scales of pay.Some others who were not posessing the mandatory eligibility criteria were given ugc scales from 01.01.1995. after legal writ petition and writ appeal i.e 21 years later, the govt has held me entitled for ugc scale from 01.07.1994. since i was not working on ugc scales I did not particicipate in orientation course whic is mandatory only for persons getting ugc scales. 21 years later the government admits that I am ENTITLED for ugc scales. But they are denying me promotion due to me on 1.7.2000 because I have not attended orientation course. should not the government be held to compensate the loss suffered by me due to delay of 21 years of grant of ugc scales. i have not attended orientation course but i have delivered several lectures to participants of orientation course.IN my wp, the court has ordered to consider my promotion within two months.Even after 5 years the order is not appealed against by the govt.participation in orientation as a disqualification is not pleaded in the WP stage. The order in wp has become final. The order is not challenged. today, the government issues me an endorsement that promotion cannot be given because of non participation in orientation course.MY contention is if on 01.07.1994 itself if ugc scale was granted as done to every other person in the state, if I HAD NOT ATTENDED orientation course, the demand by the govt is correct.Having not given me ugc pay on 01.07.1994 but by giving me 21 yera later for NO FAULT ON MY PART the govt's claim of orientation course from me for promotion is bad. OKEASE,PLEASE ADVISE.
