Non-payment of society maintenance charges

Our housing complex about 7 years old was registered only last year-May'16.Out of 60 flats,abt 15 flats owners stay,others on rent.Of the 4 buildings in the complex,3 buildings have 16 flats each of 990sf ft built up,1 building has 8 flats of 1270sq ft and 4 flats of 1670sq ft. while society maintenance were collected at uniform rate,it has been decided by the management to collect maintenance charges based on sq ft.we have annual general body meeting,but attendance is poor,so we had sent letters to all members and we have received 46 replies against total of 60 and majority is for sq ft basis(also tamil nadu govt act provides for collection of maintenance charges proportional undivided share of land - which is again related to area of flat.) pending ratification in general body meeting in june'17,management has decided to collect charges proportional to sq ft,from april'17(new financial year). about 5 owners( - staying out) of larger flats are not complying,stating that the charges have to be uniform and increase to be effected only after discussion in general body meeting in june17.What is to be done? pl advise.regards v krishna moorthy
