Code of civil procedure u/s order vii rule 1 of cpc

I have a property owned by my grandmother at Chennai. She has settled the 3/4th of the property to my father and 1/4 of the property to my three aunts (Father's sisters). One of the aunt had no children and in the settlement deed my grandmother had mentioned that if the three aunts want to sell the property they should sell it only to my father and the aunt who is issue less should deposit the sale proceeds received from the sale in a nationalized bank and after the life time of the aunt it should go to my grandmothers second son. My father acquired 1/4th share from his sisters by way of release deed settling the amount due to them and in 2008 wrote a settlement in my favour stating that my mother should enjoy the property during her life time and I should become the absolute owner after my mother's life time. My father died during January 2010. I got a release deed from my mother foregoing her life interest and tried to sell the property. My uncle (father's brother) has now filed a suit stating that he is eligible to get the share of his sister (my aunt). I have filed a suit. Will I get a favourable order from the court.
