Quary on divorse

My marriage was solemnized on 15/12/2015 at Jalpaiguri , West Bengal and after Marriage we led our conjugal life at my home at Jalpaiguri, the marriage was consummated and the said marriage was registered under Hindu Marriage Act on 24/12/2015. Due to difference in taste, attitude, nature, habit, we couldn’t pull on our marital relation peacefully for which they separated themselves from each other and on 27/12/2015, my wife left the matrimonial home absolutely on her won due to in capability to adjust ourselves and since then She has been living separately from me till date absolutely. we mutually arrived at a decision to dissolve our marital tie on the basis of Divorce on Mutual Consent. A deed of agreement is made on 20/08/2016, mentioning the conditions given below in presence of notary, 1. It is mutually agreed between the parties that their marriage, so solemnized on 15th day of December’2015 and registered on 24th December’2015 shall be dissolved by a decree of Divorce on Mutual Consent and both parties shall file petition for Divorce on Mutual Consent u/s 13B of Hindu Marriage Act 1955, in the Hon’ble Court of District Judge, Jalpaiguri within 1st part of January’2017 i.e. after completion of one year separation of the parties. 2. It is mutually agreed between the parties that the 2nd party will not claim any maintenance or permanent alimony from 1st party in future in relation to their marriage. 3. It is also mutually agreed between the parties that the 1st party shall return all STRIDHAN i.e. gold ornaments on 20/08/2016, in presence of witness with proper receipt. 4. Furniture’s which is given by the 2nd party to the 1st party shall be given by the 1st party on or before of the final hearing of the Divorce Petition. 5. That the 2nd party hereby declare and assure the 1st party that neither she nor her guardians or any persons on her behalf lodged any written complain in the Kotwali Police Station or any Police authority against the 1st party and /or against any of his relation and further under takes that, neither she nor any of her guardians or any persons on behalf of her shall lodge any criminal case against the 1st party or against his relation in respect of their matrimonial relation or conjugal life in any manner what-so-ever, in future or at present. 6. That the 1st party and his guardians or any persons on behalf of 1st party also undertakes not to take any legal action / any criminal case of any kind in any manner what-so-ever against the 2nd party or her relations in future or at present. 7. Both parties declares that this deed of agreement is made for common benefit and mutual interest of both parties. The contents of this agreement have also being read over and explain in Bengali and on being satisfied both the parties. In witness, whereof both parties understanding the contents, meaning and effect of this deed put their signature voluntarily on their own accord with sound mind and health and without any persuasion or influence from any other on this 20th day of August’ 2016. But now in the first week of January-2017, when I want to file the mutual consent petition, my wife says that she will not file the petition till I will not return the furniture. It may be possible that she might claim permanent alumni / maintenance charge in future. My question to you, 1. What should I do now ? 2. Can I file any 420 case against her ? 3. Can I file divorce petition now ?
