Booked villa with Godrej properties in greater noida

We did have in our mind the great brand name of the GODREJ as such and without much thought or debate, decided & agreed for the proposal, as was brought by Brokerage company, which in itself a reputed & renowned Establishment in between us & the builder, further doubled our zeal in deciding to book. With the above in view,we took the decision to book the Villa supposed to be our dream home- large & spacious one with the front & back garden. As it was explained and understood/construed by us was that the size of the piece of plot (where the Villa proposed to be constructed) will be 2359 sq.feet {(i.e. as was indicated too in the Drawing mailed by broker as well as indicated in the Drawing given by Godrej office people) as built up area)} means there by that the plot size approximately will be 40 feet by 60 feet I.e. (40' * 60') = 2400 sq.ft. just as equal to 2359 sq.ft. as was discussed & indicated in Drawing/other documents too. We never had any iota of doubt/suspicion wrt the size of the plot where the independent villas are proposed to be built/constructed at till just two/three days back when the same was observes by my elder daughter when she calculated the size in approximation. Then only came to our notice when we roughly again measured and added the size of different rooms,toilets walls etc. by going through the drawing. When it was calculated in this appx. manner by adding the different rooms/other ares such as toilets, walls etc., the size of the plot land /built up land area comes to only around 22' * 30' measuring to 660 sq. ft.exclusive of lawn area etc. It means it is not of the size as we discussed,were explained/apprised by the broker company and Godrej Reps. On contacting today with broker & through him to M/S Godrej Rep, it was explained that it is the total FAR area of the entire floors. At no point of time/occasion, it was communicated /shown/explained to us nor does the drawing indicates anywhere that the entire FAR of all the floors will form the part of plot area or be included in the plot / built up area. At no place the FAR of all the floors been shown/indicated any where or ever so discussed at any point of time ever. At one place, they have shown the built up area as 219.56 sq.mtrs (i.e. 2359 sq.ft.) and at other place, it is indicated as 436 sq.meters as saleable area. With all this, the doubt arises that there was & is something which were hidden from us, we were kept in dark and the things are not transparent as such as we expected/presumed to be from any reputed builder of Godrej stature. Besides the above, we did communicate to the broker about our other concerns too relating to the Section K (T&C) which forms the part of the application, by visiting brokerage company Noida office explaining that there are no. of them, as were explained, which are totally one sided & loaded in favor of the builder. It was on their explanation /clarification to us that all these are applied universally by the builders in India and these are similar everywhere. But after application of RERA/Rules-as explained by them-framed there under by the concerned state, the same ( I.e T&Cs) would be amended/modified in due course of time. It was also empathized that as the Godrej being a brand name in itself & is a very renowned and reputed builder, we need not to bother as it is the responsibility of our company from the start to the end- till the villa is registered in the name of the purchaser to take care of each & every activity. Taking the above into consideration, we were convinced and we proceeded further. However, with all the above, the basics (i.e the size of the area where the villa is proposed to be built up) have been defined and interpreted entirely in the different way when the same was telephonically discussed with broker and godrej rep. . It is, as a matter of fact, very painful for us to hear this and are therefore forced to think other away round. In case the size Area of the plot (i.e. Length & Width/the total ground/Land area) as brought out above is less than what has been indicated in the drawing (which is 2359 sq.ft.), we expressed our wish not to continue our relations as the buyer of said villa booked by us through broker and requested to take up the matter with godrej properties for returning our booking amount of ?5,00,000/- (Rupees Five Lacs only). When we requested for cancellation instead they threatened us to continue otherwise as per application form terms they will not refund any of the booking amount. Despite repeated requests to customer service team we have not got any mail confirming cancellation and refund for booking amount paid. What legal action can we take in this regard to get our hard earned money back?
