• Non payment of salary

Joined Medical College in March. Had to go for fellowship and training to Pune. Leave not sanctioned. Left for training in April. When came back the College authorities did not let me join and also refused my salary for the period which I worked. How to proceed further??

When leave was not granted you should not have left. The college authorities were right in not allowing you to jail. Furthermore, the college can deduct from your salary the damages it suffered, but deduction cannot be over and beyond the loss suffered by the company. Consult a lawyer with specific facts as to the salary withheld by the company and the duration for which you left the company and the appointment letter.

1) issue legal notice to college to pay you salary for period you worked as doctor

2) if college fails to pay file summary suit to recover your outstanding dues

Send them a legal notice to forthwith release your salary in arrears. If does not helps, drag them to the Court.

1. it is not clear the service rules ofthe college and whtehr your elave was anctioned or not.

2.Without knowing all these details it is very difficult to advise.

3.however to recover your arrears salary you can file both civil and criminal case.

If it was a government medical college then you can write a representation and after that you can proceed and file a Writ Petition. Also please tell your problem in detail so that I can give you a good suggestion, I will have too see the terms and conditions of the admission etc.

You have to visit your employment offer letter in this regard for the conditions therein.

If you were not granted leave then your absence would be considered unauthorized.

You may have to make a representation to the management to your absence and to allow you join back.

You can demand your arrears of salary.
