• Delayed death certificate and heir certificate

My mother passed away in Greater Noida. At the time I could not get a death certificate made. I did try and submit required documents but the officer asked for a bribe and never got it done and the file was lost. I do possess the hospital letter of date and time of death and also the cremation certificate. I now need to get a death certificate issued so that I can get a legal heir certificate for some property related issue in West Bengal. I am looking for a lawyer in Noida who can take care of this end to end.
Kindly advise and assist.

Yes, a death certificate to be issued by the local Municipality is mandatory.

If giving bride is an issue for you then you can bring this to the notice of the Municipal Commissioner.

You may approach the authorities concerned with an application directly, signed by all heirs of your mother seeking the death certificate.

You don't require any Advocate to do this job.

Based on the documents available with you,  get an order from the jurisdictional and competent Court directing the authorities to issue the death certificate of your mother.

Dear Client, Since the death was not registered within the mandatory 21 day window you must follow the procedure for late registration of death under section 13 of the Registration of Births and Deaths Act 1969 Because this is a delayed application it cannot be processed through standard online portals alone it requires a formal order from a magistrate You will need to submit a return application to the local registrar of Births and Deaths in Greater Noida supported by a notarized affidavit explaining the delay the hospital’s death report and the cremation certificate.

To move forward you should approach and Executive or First class Magistrate in Greater Noida to obtain a directive for the registrar to register the death the documentation you already have that is the hospital letter and cremation certificate is vital and will serve as primary proof of the event It is also advisable to prepare affidavits from two witnesses who can confirm the date and circumstances of your mother’s passing as this is often required for late registration once the magistrate issues the order you submit it along with your application to the registrar who will then enter the details and issue the official death certificate.

Regarding professional assistance you can seek out a legal consultant in the Greater Noida area that specializes in document registration When you meet with a potential lawyer or consultant especially ask if they have experience obtaining a magistrate’s order for late death registration in Gautam Budh Nagar as this is the crucial legal step that differentiates your case from a routine application. I hope this answer helps, if you have any further query kindly do not hesitate to contact us. Thankyou

Dear Sir/Madam,

Since the death occurred in 2012, it can still be registered. You must obtain an order from the concerned SDM/Executive Magistrate having jurisdiction over the place of death in Greater Noida, after which the local Registrar can issue the death certificate.

The hospital death letter and cremation certificate are important supporting documents. Engage a local Noida advocate to file the delayed-registration application with an affidavit and complete the verification process.

After receiving the death certificate, the appropriate heirship document can be obtained in West Bengal, depending upon the property and authority concerned.
