Basically, we are living in Dubai, UAE as employee visa I have this question with a lawyer as I am planning to marry a Pakistani girl (Kranchi) through the UAE. What will be the procedure to obtain an Indian visa for the wife, and what will be the consequences as publicly stated, and is it a special marriage under police protection? And family protection issues

Since you are working in Dubai on an employment visa..you can legally marry a Pakistani citizen in the UAE as per local marriage laws. Such marriages are recognised if properly registered...

After marriage, your wife can apply for an Indian visa on the basis of marriage... Normally, this will be a Long Term Visa and the application will go through the Indian Embassy... Final approval comes from the Ministry of Home Affairs in India so the process takes time.

Because the spouse is a Pakistani national, the authorities will do thorough background and security checks... This is standard procedure and not a problem if everything is genuine but delays are common.

This is not treated as a Special Marriage under Indian law unless you separately register it in India.   There is no automatic police protection but police verification may happen later.. especially when she enters India.

Being from UP does not make the marriage illegal but local procedures and verification can be stricter and slower compared to other states...

the marriage is lawful, the visa is possible, but you should be prepared for extra scrutiny and patience with the process.

Hello,

You can legally marry a Pakistani national while living in the UAE, and the marriage can be done under UAE law and later recognised by Indian authorities. After marriage, your wife can apply for an Indian Entry (X) visa, but because she is a Pakistani passport holder, the process is slow, involves strict security clearance from Indian authorities, and cannot be done through e-visa. Once she enters India, police/FRRO reporting is mandatory as a nationwide security requirement. The marriage should also be registered in India, preferably under the Special Marriage Act, for full legal validity. There is no automatic police or family protection just because of nationality, and OCI is not available to Pakistani spouses. If procedures are done in Uttar Pradesh, the law is the same as elsewhere in India, but in practice the scrutiny and delays can be more intense.

Since you are an Indian citizen, you can register the marriage at the Consulate General of India in Dubai (or Embassy in Abu Dhabi) under the Foreign Marriage Act, 1969. 

you may submit “Notice of Intended Marriage”, sworn affidavits, passport/visa/EID copies, and photographs, you must prove you are single (from India or UAE), your Pakistani fiancé will need a non-impediment certificate / affidavit from the Pakistan Consulate stating she can legally marry you, a publication in UAE (and sometimes India) to announce the intended marriage is required before registration. and 3 witnesses with valid UAE residence visas must appear.

Your wife will not be eligible for e-Visa (Pak nationals must apply through the Indian mission). Typically she can apply through the Indian Consulate in Dubai/Abu Dhabi for a visa to visit India — e.g., a tourist visa, entry visa, or other relevant category.

Marriage registered in UAE at Indian Consulate is valid, but if you want full legal recognition in India (for immigration, proofs, spouse benefits) you might also want to register it in India under the Special Marriage Act, 1954. This is often recommended for inter-national marriages since it gives clear legal standing in India.
