You can still complain against her and lodge a fir for cheating without thinking that you were unfair
A loan agent Swati called me few weeks ago. I told her I have few personal loans which I want to convert into 1 single loan, amounting to approx. Rs 50 lakhs. I shared my PAN, Adhar, Salary Slip, Bank Statement and Cibil report through WhatsApp. After two days she replied:- Sir, you are not eligible for this amount, but we can still help you get a fresh loan of Rs 50 lakh which you can use to close your current loans yourself. We'll modify your docs, inflating your income & hiding your current obligations. We have connections in Yes bank, and can get this loan sanctioned by paying bribe. So sir, let me know if you are ready to pay Rs 1 lakh, otherwise you can forget about getting any loan. I was desperate to consolidate all my loans into one single loan, and had already been rejected by banks citing income not enough. So I decided to accept her offer. She sent me UPI details of two individuals and asked me to transfer Rs 50k each in these two accounts. I did as told. She replied after 1 hour:- Sir, bank's verification team will call you shortly to confirm your basic details. Answer the purpose of loan as medical emergency, You have no current loans running, and you have not made in advance payment. After few mins, this verification call comes and I reply to all the questions as guided by Swati. Swati replies next day:- Sir, our personal contacts are feeling nervous and they don't want to get caught. So they have suggested you pay first six EMIs in advance. This will make your case stronger. So sir, can you arrange about Rs 4 lakh today? I kept insisting that I do not have such an amount right now but she kept persuading me to arrange it from somewhere otherwise loan might get stuck. So next day I withdrew cash from my credit cards and transferred one lakh each in four different accounts provided by her. She then asked me to wait for one day for the loan amount to get disbursed. Next day she responds:- Sir, our disbursal team contact has met with an accident. So we are aligning someone else, but then even that person is demanding his cut. So sir can you send Rs 50k more so that we can pay this person and get your loan disbursed quickly? At this point I told her that I'll not pay anything more. If they cannot get my loan disbursed they better return my 5 lakh. She kept insisting to pay and get the loan disbursed but this time I did not. I asked her to return my 5 lakhs. She said she will get my 5 lakh refunded. It's been few weeks I haven't got my money back. Swati keeps saying it is still in process and will take another few days. Now she has switched off her phone. The person who called from bank to get my details verified is not answering calls. I have no loan notifications from bank. I want to lodge a complaint to get my money back, but I may end up exposing the fact that I was okay with getting the loan through unfair means like lying to bank verification team, letting agents modify my docs and paying bribe etc.

This is a classic case of financial fraud and cheating by a loan scammer, unfortunately quite common in India. Even though you were persuaded to participate in the process involving falsification of documents and paying a bribe, you are still a victim of a serious crime—cheating, criminal breach of trust, impersonation, and possibly identity theft, all punishable under Indian law.
Your willingness to provide false information or pay bribe may amount to wrongdoing, but the main offence is by the agent and her associates, who defrauded you by misrepresenting their ability and connections, taking large sums with no intent to actually process any legal loan.
Indian law recognizes the right of the victim of cheating to report the crime—even if you may have made mistakes yourself, the primary liability is on the scammers.
In practice, police may question you about your role in the process, but the focus is on the perpetrators who are running a criminal racket.
Gather all proof: WhatsApp messages, call logs, payment screenshots, bank account details where money was transferred, and names/numbers associated.
Prepare a formal written complaint to your local police station, describing the facts truthfully and clearly highlighting that you realized you were a victim of fraud and want to cooperate.
If uncomfortable going to local police, make an online complaint at www.cybercrime.gov.in (the government cybercrime portal), which allows anonymous and secure reporting of financial fraud and digital scams.
Clearly state in your complaint that you were desperate and misled by the promise of consolidation, but you never received any loan and the agents have now absconded with your money.
Police or cyber cell will follow up—providing your honest cooperation may reduce your risk of being blamed, especially since most such victims are NOT prosecuted but are treated as complainants, unless they actively ran the scam.
Report to your bank immediately as well—sometimes, quick reporting helps track or freeze suspect accounts.
Going forward, avoid responding to offers for any "shortcut" or "fix" through agents, as these are illegal and always run the risk of fraud, prosecution, and loss.
If you wish to proceed and need help drafting your complaint or need representation, you can contact us. Your rights and remedies are still available, and reporting the crime also helps prevent others from being duped.
You’ve been cheated in a loan scam. File a complaint immediately on cybercrime.gov.in and at your local police station with all UPI IDs, chats, and payment proofs. Also alert the banks where you transferred money to try to freeze those accounts.
Focus on the fraud; don’t admit to “bribe consent” — say you were pressured and misled. Recovery may be hard, but complaint is essential to protect yourself and block misuse of your documents.
- You should immediately lodge a complaint to the police against her and another persons in which account the amounts were send by you . Mention their contact numbers and UPI numbers
- Further, lodge a complaint before the cyber cell online mode after giving all the details
- Further, if you know their address or bank name then you can also lodge a complaint in that bank.
If you lodge a complaint narrating only the fraud part (money taken on pretext of arranging a loan, then agent absconded), you will not expose yourself.
If you mention the bribery/misrepresentation angle, you may attract trouble for yourself.
So the safe way: focus only on cheating and fraud, not on the fact that you agreed to false documentation or bribe.
Here’s the crux:
You have been cheated of ₹5 lakh by fraudsters posing as loan agents.
Offences committed: Cheating (420 IPC), criminal breach of trust (406), conspiracy (120B), cyber fraud.
Your role (agreeing to fudged docs/bribe) is technically wrong, but since no loan was disbursed and you lost money, you will be treated as victim, not accused.
Action to take:
File a complaint on the National Cyber Crime Reporting Portal and at your local Cyber Cell/Police Station.
Provide UPI receipts, WhatsApp chats, numbers, and all evidence.
In complaint, focus on being defrauded by “loan processing scam”; no need to highlight your willingness to fudge documents.
Recovery is uncertain, but police can freeze accounts if you act fast.
👉 Best course: File cyber fraud complaint immediately; you are on safe ground legally.

I have carefully reviewed the facts narrated by you. Unfortunately, the circumstances indicate that you have fallen victim to a loan scam, which is increasingly common in Delhi NCR and other metro cities.
Nature of the Fraud
The so-called “agent” has taken advantage of your financial distress and lured you into transferring money on the pretext of arranging a loan.
The promises of “modifying documents, inflating income, and paying bribes to bank officials” are typical tactics of fraudulent loan rackets.
The “verification call” you received was almost certainly from an impersonator, not the bank.
Your Role and Legal Position
You are understandably concerned about admitting that you followed instructions to misstate facts to the bank.
While you did repeat false statements as guided, the real offence here has been committed by the agent and her associates, who cheated you of your money.
Courts and police recognise that victims of such scams are often manipulated, and your primary intention was to secure a legitimate loan.
Legal Remedies Available
You can lodge a criminal complaint for cheating, fraud, and criminal breach of trust under Sections 406, 420, 468, and 471 of the IPC with the local police or cyber cell.
Since payments were made through UPI transfers, the beneficiary account details and transaction IDs can assist the police in tracing the culprits.
A parallel complaint may also be filed on the National Cyber Crime Reporting Portal (www.cybercrime.gov.in).
How to Present Your Case
In your complaint, focus on the fact that you were misled into parting with money under the false promise of a loan, rather than highlighting any willingness to misrepresent information to the bank.
You should present yourself as someone deceived by fraudulent assurances. Police are primarily concerned with dismantling such rackets rather than prosecuting victims.
Next Step:
I strongly recommend filing a cyber fraud complaint immediately, enclosing copies of WhatsApp chats, UPI transfer receipts, and any phone numbers or account details you possess. This will significantly strengthen the chances of tracing the fraudsters.
We can assist you in preparing the complaint in a legally sound manner, ensuring that your interests are safeguarded while pursuing action against the culprits.

Dear Client,
This is a clear case of online loan fraud where you were cheated of around ₹5 lakhs, and the correct course now is to treat yourself as the victim of cheating and cybercrime — you should immediately file a complaint with the local cyber crime police station or through the national cybercrime.gov.in portal, providing proof of transfers, UPI IDs, WhatsApp chats and call records, and ask police to register the case under IPC 420 (cheating) and Section 66D IT Act (impersonation using computer resources); while you worry that you followed their instructions during verification, the law looks at your intent (to get a genuine loan) versus theirs (to extract money without disbursal), so you should focus your complaint on the fraud and manipulation rather than repeating the parts where they asked you to misrepresent, and in parallel you should notify the banks/UPI apps of the fraudulent transfers so they can try to freeze those accounts.
