We have coffee estate of 1 acre among that we have cleared 40 cents land and built home godown compound wall without land conversion. Concept of landconversion we were not aware. We have RTC of that land . People are saying we must had landconversion before. Niw we are clueless what to do. Please gelp So as a layman iam asking what should be the legal documents should I have where we should not have any problems in future?

  1. Land Conversion – Apply for conversion of agricultural land to non-agricultural (NA) use under Section 95 of the Karnataka Land Revenue Act. This is done with the Deputy Commissioner/Assistant Commissioner.

  2. Building Permissions – Obtain approval/regularisation for house and godown construction from the local Panchayat/Authority (if not already taken).

  3. Essential Records – Keep RTC, mutation extracts, conversion order (once obtained), khata certificate, tax paid receipts, and building plan approvals.

Right now apply for land conversion and then get building approval/regularisation. That way, in future, you won’t face legal or resale issues.

1. A land owner is entitled to erect farm-buildings and dwelling houses for agriculturists and their labourers, construct wells or tanks, or make any other improvements thereon for the better cultivation of the land or its more convenient occupation for the purposes aforesaid. Any change of land without permission attracts penalty in the  nature of fine.

For conversion, registered owner needs to apply to the Deputy Commissioner, on receipt of such application,
shall at once furnish the applicant with a written acknowledgement
of its receipt, and, after inquiry, either grant or refuse the same,
but if the applicant receives no answer within three months from
the date of the said acknowledgement, the Deputy Commissioner's
permission may be deemed to have been granted. Unless the
Deputy Commissioner shall, in particular instances, otherwise
direct, no such application shall be recognized, except it be made
by the registered occupant.

For the 1 acre coffee estate where you cleared land and built structures (home, godown, compound wall) without land conversion:

  • You are required to convert agricultural land to non-agricultural/residential use before constructing buildings. This process is called DC Conversion and is mandated under the Karnataka Land Revenue Act.

  • If conversion was not done, you should apply immediately at the District Revenue Office (DC office or Tahsildar) for land conversion. For any coffee estate (including 8 acre and 2 acre properties):

  • The essential legal documents are:

    • RTC (Record of Rights, Tenancy and Crops) for each survey number

    • Khata certificate and extract (reflecting up-to-date ownership and assessment)

    • Mutation Entry (reflecting latest ownership after transfer/inheritance)

    • Land Possession Certificate if multiple names appear on RTC, endorsed by Revenue authorities

    • Aadhaar/ID proof, agricultural income certificates (for loans/subsidies), relevant government registration (e.g., Coffee Board registration)

For the 2 acre estate in your grandfather’s RTC:

  • To transfer RTC from your grandfather to your father's name, revenue authorities require succession evidence. Signature of all legal heirs—including your father’s sister—is generally necessary unless a registered relinquishment deed/release deed is executed by non-cooperating heirs.

  • If they do not come forward, you or your father may apply to the Revenue Office with the grandfather's death certificate, family tree/genealogy certificate (get this online via Nadakacheri portal), documents showing succession, and file an affidavit stating efforts made.

  • If a legal heir does not cooperate, you may pursue mutation by legal process or file a partition suit to declare and update ownership.

To avoid future problems:

  • Regularize land conversion immediately for built-up areas.

  • Keep all RTC, mutation, Khata, possession certificates, and tax receipts updated.

  • Get all family members’ cooperation for succession/mutation; if not possible, take legal action for declaration or partition.

For 1 Acre Coffee Estate (40 cents house/godown built)

You need land conversion before DC office.

Pay conversion fee (10% of guidance value) + penalty (~₹1–3 lakhs approx. for 40 cents).

This will regularise the property.

For 8 Acres Coffee Estate (in father’s name)

Keep updated: RTC, Mutation Extract, EC, tax receipts, survey map, family tree, Coffee Board registration.

These ensure clear title.

For 2 Acres (in grandfather’s name)

Mutation needs NOC/relinquishment deed from your father’s sister.

If she won’t cooperate, file partition/succession suit and use decree for mutation.

 

In short: Convert 40 cents, maintain records for 8 acres, and either get NOC or go to court for 2 acres.
