• Tourist visa and marriage

Namaste. I would like to clarify a few things before applying for the tourist visa to meet and marry my boyfriend in India, then convert the tourist visa to x-visa and stay with him in India. 
1) According to the information detailed on the Indian Embassy website in my country (Ukraine), there are two types of tourist visa, e-tourist visa and regular paper tourist visa. e-tourist visa is easier for me to apply for. But it is said that e-tourist visa may NOT be converted into anything. So should I apply for a regular paper tourist visa to convert it to X-visa? 
2) How should I specify the purpose of the visa in the application?
3) What is the required duration of the tourist visa to allow marriage registration and conversion to x-visa? I know that it is necessary to book the outbound and return ticket too, but what should be the time interval between the outbound and return ticket, at least approximately? Because I have to choose the duration of staying in the visa application form.
4) Where should I live after arrival to India? The requirements to tourist visa posted on the Embassy website say that it is necessary to provide evidence of hotel room reservation for the entire duration of staying in India. But this is for tourists. Can I stay in the home of my boyfriend at this time? And if yes, is it necessary to provide his invitation stating that he invites me and lets me live in his home? If such invitation is required, should it be apostilled and delivered to me by regular mail (to be enclosed as part of other documents and given to the Indian Embassy when I apply for the visa), or is an electronic version without apostille sufficient?
5) The visa requirements posted on the Embassy website also state that the applicant should produce the bank statement and prove to have sufficient funds. But how much should it be to be sufficient for the duration of my staying in India considering the situation?

1. If you plan to convert tourist visa to X visa, then you may follow the instructions to obtain paper visa alone.

2. Initially you propose to visit India on tourist visa, hence you specify the same.

3. Indian visa validity: 
The validity of these visas is as follows: one-month tourist visa: 1 month (30 days) one-year tourist visa: 1 year (365 days) five years tourist visa: 5 years. Those on tourist visas will also need to register with the Foreigners Regional Registration Office (FRRO) in case they stay continuously in India for more than 180 days.

4. The Indian government requires a very specific and formatted Letter of Invitation (LOI) from the host company in India which differs from standard LOI's. The letter should be formatted as indicated in the example and must contain all of the listed information in the order indicated.

  • You can apply for a tourist visa to meet and marry your boyfriend in India, but you cannot convert it to an X-visa (entry visa) while staying in India. You have to leave India and apply for an X-visa from your country or any other country where you are legally residing. The X-visa is granted to the spouse or children of an Indian citizen or a person of Indian origin.
  • The e-tourist visa is a short-term visa that is valid for 30 days from the date of arrival in India. It is issued online and allows double entry. It cannot be extended or converted into any other type of visa. The regular paper tourist visa is a long-term visa that can be valid for up to 10 years, depending on your nationality and the discretion of the Indian consulate. It allows multiple entries and can be extended in India under exceptional circumstances. However, it cannot be converted into an X-visa either.
  • Based on this information, it seems that you can apply for either the e-tourist visa or the regular paper tourist visa to visit India and marry your boyfriend, but you have to return to your country or any other country and apply for an X-visa to stay with him in India. You should specify the purpose of your visa as tourism or visiting friends and relatives, and not as marriage, as marriage is not a valid purpose for a tourist visa. You should also choose the duration of your visa according to your travel plans and availability of flights. You should book a round-trip ticket with a confirmed return date within the validity of your visa.
  • You can stay in the home of your boyfriend after arriving in India, but you have to register yourself with the Foreigners Regional Registration Office (FRRO) within 14 days of your arrival. You have to provide your address proof, such as a utility bill or a rent agreement, and a letter of invitation from your boyfriend stating that he is hosting you and allowing you to stay in his home. You do not need to provide evidence of hotel room reservation if you are staying with your boyfriend .
  • You have to prove that you have sufficient funds to support yourself during your stay in India. The amount may vary depending on the duration and purpose of your visit, but generally, it should be around $50-$100 per day. You can provide your bank statement, credit card statement, or any other proof of income or savings as evidence of funds.

Madam, 

You are suggesested to apply for a regular paper tourist visa and then get it convereted to X-visa. You may justify the same as a visiting friend. Also, you may book return tickets for end/limitation period of your visa. The better option would be of having formal invitation from your boy friend. Regarding funds, it suggested to have a reserach work done through your boy friend for staying in a normal hotel and expenses for the period of stay in the city where your boy friend resides.

1. As per Indian law , e-Tourist Visa can neither be extended nor converted to any other kind of visa during the visa-holder's stay in India ,whereas , a Tourist Visa can be converted in X-visa for stay in India longer period. 

- Hence, you can apply for paper tourist visa.

You can forward documents to your fiancée abroad for her signature and she can after signing return the documents to you for filing with marriage registrar office

The Notice signed by both the parties

  • Receipt of fees paid along with the Notice
  • Proof of residence of both the parties
  • Proof of date of birth of both the parties, like birth certificate, educational certificate, passport etc.
  • Affidavit of both the parties
  • Copy of Passport of both the parties with valid Visa of the foreign national
  • Two passport size photograph of both the parties.
  • Documentary proof of staying more than 30 days in India of the foreign national.
  • No objection Certificate or marital status certificate from the concerned embassy or consulate in India by the foreign national.
  • Proof of residence and identity of all the three witnesses.

If one partner is residing in a foreign country then the partner who is resident in India will have to fill out the “Marriage Notice”  collected from the Marriage Registration Office of his/her choice in India and send it to his/her partner in the foreign country who will also have to fill it out. This “Notice” should then be sent back to the partner in India who will have to re-submit it at the Marriage Registration Office. After the stipulated waiting period of 30 days the marriage can take place in India. Under the Special Marriage Act, 1954 a certificate showing the signatures of the persons married, the registrar and the witnesses will be issued.
