• Who is responsible for paying Khata bifurcation charges in BBMP limits, builder or the buyer of flat

Our builder in Bangalore is asking that each of the flat owners pay for khata bifurcation charges, although there is no mention of that charge in any of their pricing documents or our sales agreement.

This fee should be paid by the purchaser of flat  by demand draft in favour of Commissioner, BBMP along with submission of application for issue of Khata.

Hi, normally the buyer will be liable to pay the katha bifurcation or any other charges which is incidental to the same. Once the property was sold it is your responsibility to change the katha in your name. Then you need to pay for the incidental charges also.

It is the owner who has to pay khata bifurcation charges so technically it is builder to pay. Further in terms of sale agreement too no liability vest with flat buyer.

- As per law, the ownership of the property cannot be transferred to the buyer Without a Khata Certificate,  

- Further, the property cannot be registered with the local authorities in its absence .

- Hence, it is the duty of the seller to pay all taxes and dues before selling the property 

- Hence, it is the duty of builder to pay the taxes before selling the property to the buyer , and the buyer can apply for transfer the Khata in his name after paying the taxes and fees.

As per law, the buyer has to pay the khata bifurcation fee to get the khata for his flat on his name.

It is something like the buyer paying the stamp duty and the registration charges on purchase of flat.
