• Can FIR be lodged at one Police Station for offences committed in multiple states?

A group of criminals committed fraudulent transactions of the same nature in Maharashtra, MP, and Telangana. Am I required to file separate FIRs at each police jurisdiction in each state or can I lodge the FIR at one police station wherein all the offences committed by the accused in the al the states are covered? I would prefer to file one comprehensive FIR, if at all possible. Also, are there any downsides to filing a single FIR?

You can file FIR at one police station 

 

 

The Union Ministry of Home Affairs vide communication February 6, 2014, while placing reliance on the dictum of the Supreme Court in Lalita Kumar v. State of UP, inter alia directed registration of FIR irrespective of territorial jurisdiction through Zero FIR. It had advised that
when it becomes apparent that even if the offence has been committed outside the jurisdiction of the police station, Zero FIR would be registered and the FIR will then be transferred to the appropriate police station as per Section 170 of CrPC."

Hello, 

  1. You can file a comprehensive FIR at one place by providing the requisite description of the nature of the fraudulent transactions committed.
  2. The concerned police will coordinate with their counterparts in the other states and carry out the investigation.
  3. The disadvantage of filling a sunfish FIR is that the investigation can take longer as different administrations are involved.
  4. It is advisable to initiate the process in the State where the accused are currently residing.

It would be prudent to file a separate police report (FIR) with the local law enforcement agency in each state regarding the offense committed. The report should include all relevant details and information specific to the incident in each state. This will ensure that the police have all the necessary information needed to investigate the crime in each state. On the other hand, filing a single report may not provide the police with all the facts necessary to investigate the crime in each state.

  1. If it's cognisable offence, you can and must file the complaint in the police station nearest to you, even if it has no territorial jurisdiction.

Hello,

Yes an FIR can be lodged where the cause of action took place or where the offence has been committed. You can also lodge a zero fir anywhere in India for offence committed outside the jurisdiction of that particular PS.

You can lodge the complaint with the police station where the cause of action arose. 

There is a provision for zero FIR and even there is a supreme court judgment providing the guidelines for registering a FIR for the offence committed at different jurisdiction, whereas practically  or ultimately, it is the concerned police station which will investigate the offence and try the case. 

Did the so called criminals have committed the criminal offence against you in all those states you have mentioned in the post?

Then how can it be a similar offence or the same persons involved in all the crimes. 

Hence it is advisable that you better lodge complaint in the jurisdictional police stations.

If the offenses were committed in different states, then it is advisable to file separate FIRs in each state. This is because the police jurisdiction is limited to the state in which they are authorized, and each state has its own laws and procedures for registering FIRs and investigating offenses.

However, if the offenses are interconnected and committed as part of a larger conspiracy, then it may be possible to file a single FIR in one state that covers all the offenses committed in different states. In this case, the FIR should clearly mention all the offenses and the locations where they were committed.

There may be some downsides to filing a single FIR, such as delays in the investigation or challenges in coordinating with different police departments in different states. It is always better to consult with a legal expert before deciding on the approach to take.

You should file single FIR, select the state where major transaction takes place. As it is seen you resides in Mumbai it is better to file FIR in Mumbai as the police in Mumbai are better equipped with to handle these types of criminal.
