You have no share in maternal grand father property during your mother lifetime

on grand father demise property would devolve on his class 1 legal heirs ie your mother and her siblings only

Your mother can claim a share out of her father's property as a right provided he is reported to have died intestate.

During her lifetime your mother becomes the absolute owner of her share in the property.

Hence, in this situation you don't have any rights over this property.

If your mother is not interested in taking her share in the property and has relinquished her rights in it by executing a registered release deed then neither you nor anyone can claim her share even after her lifetime.

if your maternal uncle has already divided the property among themselves, then it may be difficult for you to claim your grandfather's property.

If your mother executes a Relinquishment Deed during her lifetime, it will not be possible for you to claim share of the inheritance..

i think this question should not even be allowed to be posted when it asks the lawyers to call the person on her whatsapp number

that is complete nonsense and intolerable

why will any lawyer call you Madam

it is you who is seeking an answer to your legal case

so you ought to call any lawyer of your choice from this platform by booking a paid phone consultation

stop making a mockery of the profession

will you expect any doctor to call you for your medical problem?!!

coming to your query:

you have got no locus to claim in the property of your maternal GF

you are not even his legal heir

your mother is still alive

you can claim only through your mother

that is, your mother would have inherited an undivided share in her father's property being a class 1 legal heir u/s s.8 of the Hindu Succession act, 1956 read with schedule 1

after the demise of your mother, her undivided share in her father's property will devolve on your mother's legal heirs, which would include you

so you can claim only through your mother after her demise and definitely not during her lifetime

Admin: plz dont permit such questions on the platform which disrespect the lawyers by asking them to call on the person's whatsapp number. it is disgusting to say the least !!

dear client,

The laws related to inheritance and property rights vary depending on the country and jurisdiction involved. However, in general, if your maternal grandfather passed away without leaving a will or without specifically disinheriting you, you may have a legal right to a share of his property.

However, if your maternal uncle has already divided the property among himself and other family members, it may be more difficult for you to claim a share. You may need to consult with a lawyer who specializes in property law to review the specific details of your case and advise you on your legal rights.

It's also worth noting that family relationships can be complex, and pursuing a claim on a relative's property may have emotional repercussions. It's important to weigh your desire for any potential inheritance against the impact it may have on your family relationships.

Ultimately, the best course of action will depend on the specific details of your situation and the laws of the country and jurisdiction involved. I recommend seeking the advice of a qualified lawyer who can guide you through the legal process and advise you on the best way forward.

- During the life time of your mother , you cannot claim any right over the property of your maternal grandfather, and only after the demise you can claim the same.

- Further , only refusal of not claiming the property by your mother is not enough , and hence even if she refused to take the share orally then also you can claim mothers share in the property after her demise.
