• Transfer of ownership of vehicle Scooty

My Father in Punjab has a scooty which we want to give to my friend's family in Bangalore. We want to transfer the ownership of vehicle to Friend's Mom. Father can't travel to Bangalore . Scooty's number is of Punjab. How can we get it transferred? Father has got some Affidavits from court where its written that he is selling the scooty to Friend's mom. In that Affidavit for Friend's Mom Chennai's address is mentioned as it's the address mentioned in Adhaar. Current address is Bangalore. Do we need to get the affidavit with Bangalore address? and what process do we need to carry out in Bangalore so as to get the ownership transferred.

According to the Indian Motor Vehicle (IMV) Act , the transferor has to intimate the Regional Transport Offices (RTO) within 14 days of the transfer of ownership. Similarly the Act also instructs the transferee to inform the RTO about the change in vehicle ownership and produce all the required documents within 30 days of the transfer.

 

 

2) The transferor is required to fill Form 29 while the transferee is required to fill in the Form 30,

 

 

3) send a letter to RTO where your scooty   is registered informing them that you have sold the scooty  and handed over original papers of bike to purchaser

 

 

4) take payment by cheque 

 

 

 

5) obtain her signature on delivery note

Contact the RTO in the state where the scooty is registered to find out what documents are needed for the ownership transfer. Documents may include a Transfer of Ownership form, original documents from the current and new owner, and an updated Affidavit with the new address. Once the documents are submitted, the RTO will process the transfer and provide a new registration certificate.

Your father has to obtain NOC for Bangalore address and also has to sign the transfer order form in favor of buyer. 

Then the buyer can approach the nearest RTO at Bangalore for further formalities.

When a vehicle is to be transferred in the name  of a person, he should have some proof of local address. She can produce, phone bill, electricity bill, rent agreement etc. Father  can execute a GPA in favour of local person, he can do the formalities of transfer in RTA.

- As per the Supreme Court Judgment, if you sold your vehicle and failed to transfer the ownership through legal way, then you will remain the owner of the vehicle, and further you will be responsible for any untoward incident and accident by the buyer. 

- As per the Indian Motor Vehicle, the transferor (seller) has to inform the Regional Transport Offices (RTO) within 14 days of the transfer of ownership. 

- Further , this Act also instructs the transferee (buyer) to inform the RTO about the change in vehicle ownership and produce all the required documents within 30 days of the transfer.

- Hence, your father should give a dully signed authority letter /transfer letter in her name , so that she may approach the Chennai RTO for transferring the said Scooty in her name legally.

To transfer the ownership of the scooty from your father's name to your friend's mother's name, you need to follow the below steps:

Obtain an NOC from the Punjab Regional Transport Office (RTO): Your father needs to visit the Punjab RTO and obtain a no objection certificate (NOC) for transferring the ownership of the scooty to your friend's mother.

Get the scooty transported to Bangalore: You need to arrange for the transportation of the scooty to Bangalore. You can use the services of a professional vehicle transport company or drive it down yourself.
