• Son representation change in civil suit - senior citizen

Hello Sir,

At present My father is running Civil Suite in Andhra Pradesh Hight Court.
He has become aged and unable to travel and take care of the things. He is planning to make me as representative to attend the suite on behalf of him. 
I have sister as well. Does we both need to represent, as she is married and do not want to involve in these cases.
After my father, Does my sister also needs to involve in the case as she becomes necessary party along with my mother.
Kindly tell me, How long does it take approximately the process to make me as representative.

1) father can execute POA in your favour to attend court , engage lawyers , file affidavit in reply etc 

 

2) sister presence is not necessary 

 

3) on father demise your mother , you and your sister have to be broght on record to continue the case

Your father can authorise you to represent him in the case during his absence by giving a special power of attorney for court case purpose in your favor which will be sufficient for now.

If the case is not disposed during your father's lifetime and it is still continuing beyond his lifetime then all his legal heirs have to be impleaded as his legal representatives in the case.

At that time you can represent all of them by obtaining another power of attorney deed in your favor

1. Your father has to appoint you as his representative by executing Power Of Attorney in your favour. There's no need for your sister to represent your father, if your father appoints you to represent him through POA.

- However, after the demise of father , appearance of both with mother i.e. all the legal heirs are needed before the court /
