• Repair of full damage pillars of flat

My flat pillars and many other flats pillars as well as pillars of parking area of my housing society are very badly damaged and it needs a perfect jeckting work under the supervision of certified structural engineer .. construction dept of nagarpalika had suggested our society do a structural audit and get the pillars repaired.. but society says it owners part of work not societys . so pls guide me who should get the pillars repaired when major flats owners flat pillars and parking area pillars aur fully damage and cracked

Society has to appoint structural engineer to do structural audit 

 

based on his report float  tenders fir carrying out repairs 

 

collect funds from members and under supervision of structural auditor carry out repairs

It is a structural renovation work and considered to be a major renovation work.

The procedure to carry out this task is to obtain structural audit report from a structural engineer by the society and it is responsible for carrying out renovation work out of the corpus funds available with the society.

It can demand additional funds from all the members of the society if necessary.

If the society office bearers are not cooperating then the aggrieved members can resort to legal action against the office bearers as per procedures of law.

i am shocked at the response of the society

the land and building are owned by the society

so the society has to carry out the repairs using its funds

it cannot foist that on the flat owners

you have to bring this to the notice of the corporation because it is also the duty of the corporation to see to it that there is no damage caused to the passers by and neighboring occupants if a dilapidated building collapses

If the construction has been done under the supervision of society, it is to be totally repaired only through them. Because all the flat owners did not construct the building.

It is coming under structural renovation only hence it becomes the duty f the association to undertake the repair/renovation work and has to bear the expenses through the corpus funds. 

It can obtain extra funds only if the corpus funds are not sufficient for this work.
