I am residing in Uttarakhand since 2005.
Can I purchase more than 250 sq.m. of land in Uttarakhand as I have heard that people residing in Uttarakhand before 2003 can buy more than 250 sq.m.?

person who is a citizen of India can purchase 12.5 acres of agricultural land in Uttarakhand which is also the permissible limit under the Land Ceilings Act.

The Uttarakhand High Court on September 22, 2011 struck down the much-contentious land reforms in the state under which outsiders were prohibited to buy more than 250 square meters of agriculture land.

A division bench of Chief Justice Barin Ghosh and Justice U C Dhyani said all the citizens of the country would now be able to purchase up to 12.5 acres of agriculture land in the state under the Land Ceiling Act.

The government in Uttarakhand allows people of different States to purchase property in any hill station under the municipal limits without any size restrictions. However, for agricultural lands outside the city limits, there are some restrictions to the extent of landholding by an individual. The size of land an individual may purchase is 2,690 sq ft against the earlier 5,381 sq ft. The State government reduced the size to restrict the land ownership of people from other States. Moreover, if the agricultural land falls within the city limits, one has to abide by the Land Ceiling Act of the State.

 

A. The 2003 amendment allowed outsiders to purchase agricultural land in Uttarakhand, but only up to a limit of 500 square metres. The law was subsequently amended in 2008 by the B.C. Khanduri government to reduce the threshold to 250 square metres.

The person should be an agriculturist or an agricultural worker by profession. As per Section 79A of the Karnataka Land Reforms Act 1961, the non-agricultural income of a purchaser who must be an agriculturist should not exceed Rs 2 lakhs per year.

Anyone can purchase land in U.K. up to 2,690 sq ft. There are no restriction on purchase of residential property. One cannot purchase agricultural without permission from revenue authority.
