• No notice or hearings date from ld. Court after charge sheet was files

I have lodged 498a against my husband and charge sheet was filed back in 2019. After that there’s no notice or hearing date from court. Also, I tried to search records in the record room but nothing found. I have copy of FIR, cs no and gr no. Please advise on next step. Can I file trace out petition?

If charge sheet has been filed on court records of case would be in the record room of the court 

 

contact a local lawyer practising in said court to trace the records of your case

1) make application in court to direct office to trace out records of your case 

 

2) enclose copy of FIR and charge sheet filed in your case

You can approach the concerned police and enquire about it. 

Sometimes the police may not have filed charge sheet before court. 

Have confirmed the status of FIR.

If you are the defacto complainant then you will not get any summons from court 

You can also approach the court concerned and obtain details.

You can file a petition before the trial court and seek the details of the pending case. 

Alternately you can approach high court with a petition under section  482 cr.pc and seek direction to concerned police for filing charge sheet  or to direct the concerned court for an expeditious trial of the case.

- If the charge sheet has been filed by the I.O. of the case , then you will not be informed for the same , and only accused in the case will be called to appear before the court and to take regular bail 

- Further, only at the time of evidence of the case, the court will send you a notice to appear for deposing before the court. 

- However, if the charge sheet has been filed in the court , then there must be legal file in the record of the court 

- Since, there is no record found by you , it means that the I.O. has not filed the charge sheet before the court .

- Further, if you having FIR number with you, then you can trace the details even online .

Referring to last date on which case was posted you can request you lawyer to personally contact the section clerk/office superintendent. Such things happens sometimes. File may be misplaced, it will not be lost of destroyed. Your Advocate can also submit an application to the office superintendent.
