• Change in place of birth in passport

I have wrong place of birth in my passport. When I filed for passport, I could not find my birth certificate. So place of birth was put according to our educational documents. Recently I found my birth certificate issued and want to change the plan of birth according to my BC. I was born in Sharjah, UAE and my birth certificate was issued from consulate general of India in Dubai, UAE. My passport is issued from Hyderabad RPO. Currently I am in USA and want to correct my place of birth in passport and here I couldn’t find a proper channel for help. I have done online research for the same and most of sites including Indian embassy, vfs global dictates to get a court order from first class judicial magistrate or above. Now I want a good lawyer who can handle the case to get it done. I have few questions...
1. What is the whole procedure??
2. Can the whole thing be done without our absence as we will be in USA. If yes how??
3.what are the documents required for the process??
4. What original documents would be mandatory as the originals would be with us...
5.How long will it take to get it done??

7.From where we have to file the case??

You have to apply for a reissue of the passport along with relevant documents.

A reissue of passport can be done in US also.

There is no need for going before a magistrate.

Since passport is issued in Hyderabad you will have to obtain court orders from Hyderabad 

 

2) legal fees vary depending upon lawyer engaged by you 

 

3) it may take 6 months  to one year 

 

4) you can enclose to your application certified copy of your birth certificate which reflects actual date of birth 

 

5) your lawyer can send the papers to you for signature ,get it attested before Indian consulate

There is no Court process involved. You need to apply for reissue of passport and get the  specified changes done in place of birth with documentary proof. You can do it from U.S. through Indian Embassy. For details you can refer to question No. 50 from > AppOnlineProject< Government of India .

1. You can apply for re-issue of the passport after giving the correct place of birth including the said BC certificate. 

- If refused by the passport authority , then file a case before the court 

2. Yes, it can be possible in your absence , however you have to give POA to any relative in India for engaging a lawyer and to appear before the Court. 

- That POA should be notarized as per rule of US and attested from the consulate of India.
