  • Plot of land in our village

I live in U.K. my farther purchased plot of land in our village in1962 we have the registry proof of sale from 1962 till 2022 we had no problems but in July 2022 people knock boundary wall broken locks and are refusing to leave their say that the names on Khasra number is their names can anyone give me advice and the police is not helping me how can I get my property back because in1977 we build two big rooms on the plot

1) if police refuse to lodge FIR about criminal trespass under section 441 of IPC file complaint with commissioner of police office against local police officers refusing to lodge FIR 

 

2) you can also file private complaint with magistrate under section 156(3) of cr pc to direct police to investigate and submit report 

 

3) also file civil suit for  eviction against encroachers

You can give complaint to police and take legal action to get them out of the property. 

Secondly you file a suit for ejectment and get the unauthorized occupants ejected through court of law. 

You can give a complaint with land grabbing cell of police against the land grabbers.

If you don't get proper response from them also then you can file a petition before judicial magistrate court under section 156(3)Cr.p.c seeking direction to concerned police to initiate legal action on your complaint

File a criminal complaint in the Court of Magistrate under Section 451 for house trespass. Magistrate will direct police to register FIR, produce the accused in Court, submit charge sheet and after trial they will be punished. You need not come to India. Execute a power of attorney in favor friend/relative and get it notarized in U.S. The person named in GPA can do proceedings. After some time you can file a civil suit for recovery of  possession but wait for results of  criminal complaint as once civil suit is filed, it will be treated as civil dispute slowing criminal proceedings. Police is bound to take action on direction from Court.

You can approach civil court if it's unlawfully occupied. If you have possession then you don't have to worry. If someone is forcibly taking possession approch police. And if police is not supporting approach criminal court for urgent direction.
