• Fake siganture on transfer of property and fake signature in court

I am Hiren Gandhi, i got in knowledge that my younger brother and father made my fake signature on transfer of proerty as well in Private Limited Company and also in court.
how ever it was happened in 2005 but i know in last month

- You can lodge a complaint against them for the offence of cheating ,breach of trust and forging the documents before the local police after mentioning that you came to know presently about the said offence committed by them.

- If not response from the police, then you can file a complaint before the Magistrate in court .

- Further, you can also recover the paid amount by you after filing a Declaration and recovery suit against them.

You can challenge the MOU and also dispute your signatures stating that they were forged  and proceed with further acts without your consent or permission.

If you have rights and interest in the family property/business and this MOU has actually deprived your rights or going against your interests, then you can file a suit for cancellation of the same and also an order of permanent injunction agaisnt them refraining them from proceeding on the basis of the false MOU.

Limitation for filing criminal complaint  runs from the  date of knowledge offence. Though offence is committed in 2005, knowledge of offence occurred to you 2022. You can still file  criminal complaint. It is claimed that also one they MOU for family property participation and under these MOU they accept liablity of bank but they did not refund the  loan and you cleared the  loan. Why you did not raise objections at the  time making payments and why did not immediately file a criminal complaint. You need to explain this. Of offence committed is documentary it can be established against them. File a criminal complaint  under Section 468, 471, 416 and 420 in the  Court of Magistrate  directly as police will hesitate to register compensation. Court will direct them the  investigate and register FIR.
