• Parental pressure and no consent marriage, annulment help needed

Hi, I am a 30y old female and I recently got married by force and emotional trauma by my own parents. I was emotionally abused to something I did not commit to. I fought until the last day but I finally succumbed to the pressure. I even tried to convince the guy on multiple occasions but he had no interest to cancel the wedding, he knew that I was doing this out of force. Now I am in a depression and I lost all hopes for my future. I need help I did my research and saw that I need to be married for 1 year to be eligible for Divorce. But I dont think I can survive even a single day in this depression and trauma. I read somewhere that Annulment could be done to void the marriage as there was no consent from my side to the Groom or to my parents. Please help me get past this and I am seeking help if this could be done without involving my parents again. I dont want to go through another episode of harrassment from them or the guy. I am willing to get this done asap and leave. Please help.

File petition for anullment of marriage on grounds that you were forced to marry against your wishes 

 

it should be filed within period of one year of marriage 

 

enclose copy of correspondence exchanged with your husband

A marriage can be annulled only when the consent of spouse was obtained by force. Such petition should be filed within one year of marriage and marriage should not have been consummated. Depending on the locality you reside you can file such petition in Family Court of Seunderabad of Hyderabad.

Dear client, 

In this case, you can annul the marriage by stating that the consent of the petitioner was obtained by fraud or force for the ceremony of a marriage, but you have to keep in mind that this will be very hard to prove. another option is to take a decree for judicial separation under the Hindu marriage act and then after the expiration of the statutory period (one year) you can go for divorce.

- As per section 12(1)(a) of Hindu Marriage Act, non consummation of marriage is a ground of divorce and annulment of marriage . 

- Hence, if you have not passed the period as husband and wife , then you can file a petition before the court for declaring the marriage as null and void without waiting one year.
