In case of misconduct by a lawyer, you can approach the disciplinary committee of the State Bar Council or the Bar Council of India. You can refer to Section 35 of the Advocates Act, which lists malpractices. However, there is ambiguity on whether you can approach a consumer court. According to what I think, though the lawyers cannot be held responsible for the outcome of the case, if there is a deficiency in his services, the client can proceed against the lawyer under the CPA since lawyers charge a fee for the services they render.
Lawyer in New Delhi took my money and lost my documents. What to do?
I hired Karan Thukral in 2019 to help me with a case I had pending with the NCDRC in New Delhi. It was a case against a builder who kept trying to extort money from me before he handed over the property I paid him to build for me. The Thukral Law firm took my money and then for the next three years did absolutely nothing with my case. When I would call the office, they would never connect me with Karan Thukral. When I could call him directly he would hang up the phone on me. My case kept getting tossed around their junior lawyers (interns) from Mr Kapil to Mr Avi Leuna, to Ms Neha to Ms Ashika. By 2022 when the courts had re-opened again, I called the Thukral office once a week asking when my court date is. They never gave me an answer. I texted, I emailed, again no answer. I tried numerous time to contact the NCDRC, but there was never any response from them via email and when I called nobody would answer. Their online system was non-functional. Finally in July 2022 after tremendous frustration I got Karan Thukral on the phone (for the first time in 3 years) and confronted him on this unprofessional treatment I had received for so long. He started a thirty (30) minute shouting match with me. Spewing at me the most vulgar profanity I have ever heard from a lawyer. I then, no doubt decided to get my file back and transfer the case to another lawyer. This new lawyer checked the NCDRC records and told me that I had a court date at the NCDRC in June of 2022, but nobody from the Thukral law firm even attended it! In August of 2022 when I went to collect all my documents from their office they only returned to be a few of the files I had originally given them in 2019. Numerous documents/files were missing and despite several attempts, they never gave me back all of my original documents. Most likely because Karan Thukral had cooperated with and taken a bribe from the other party that I filed the case against (Masood Hasan of Countryside Realtors). Filthy crooks. Karan Thukral has no place in the legal profession, he should and must be disbarred. How many more innocent clients he will scam and treat like garbage before action is taken against him? I will report him to every bar council in India, Canada and the USA. P.S. All the positive reviews on google for his law firm are fake. Written by Karan Thukral himself.

You should file a complaint against him and his associates before the bar council of India immediately.

- Regarding the lost documents in the original, you must get an FIR lodged, so that you can use the photocopies as secondary evidence.
- You must also seek a written note from the lawyer concerning the lost documents as acknowledgement .
- You also have the option to approach the state bar council regarding unprofessional behaviour of the lawyer you engaged.
If you have documentary evidences to prove the acts of cheating and deceiving you by the said law firm, you can submit a complaint before the Bar council of Delhi against the firm expressing your grievance and request for proper action to be initiated against the law firm and get your grievances redressed properly.
You can file a case before bar council. Also file civil suit for damages
You can lodge a complaint before the appropriate Bar Association first submitting evidence in support of your allegations.
If lawyer has cheated you file complaint against him before state bar council
you should not make any allegations against a lawyer unless you are able to substantiate the same
Initially you can take this to Delhi Bar Association. Before that you can ask him to come on table for discussion.
- Since, you have entered with that law firm for getting relief , then the said lawyer is bound for the same after giving its better services
- You can lodge a compliant against that firm before the Bar Council of India , if you have sufficient proofs against him, and if you have paid him for the same.
- Further, you can issue a legal notice as well for taking legal action against the said firm.
