Power of attorney should be attested before Indian consulate
Hi, My parents had sent me 5 pages pdf of general power of attorney and they want me to notarize it on first 4 pages with sign of attorney. Should i notarize it in any bank or do i need to notarize it in indian embassy only?
To get the POA notarized, visit any Notary near to you or go to Indian Consulate and get the POA countersigned by an Indian Consulate Official.
So, in the witnesses page i had my father name. So how can my father sign it as he lives in india.
You can get it attested by a local notary public or by an official of the indian embassy.
The attestation by a bank official is not recognised to be valid.
You have to remove his name and put some other person available in the local as a witness, your father has to fly to your country of residence if he has to sign as a witness, hence avoid legal issues.
After the POA is notarized in your place, it will be sent to India. After it reaches your parents' place, let your father put his signature as one of the witnesses before it's submitted to the jurisdictional District Registrar's Office for adjudication.
You need to give the poa in favour of father he can sign it through notary but your sign should be attested through embassy. His sign can be attested through notary in India.
1) Its compulsory to notarize General Power of Attorney in Indian Embassy only.
2) Please change the witness name.
Please do not mention your father as a witness. You need to have two witnesses living in the USA now to sign the GPA deed and it needs to be attested by a Notary there. Alternatively, it can be attested by our Embassy or Consulate there.
- As per law, that GPA should be notarized as per rule of US , and attested from the consulate of India
- Since, this GPA is going to executed in US , then it should be signed by you in the presence of local wittiness , and not the person who is living in INIDA.
1. You shall have to get the same attested by the appropriate officer of your local Indian Consulate and return it to your father for his further doing the needful
2. No Bank can notarise a POA to be legally valid in India.
