• Obtaining copies of evidence submitted by wife in MC, GWOP

Hi

How can I obtain copies of evidence submitted by my wife on her MC case filed in 2019 which was originally set to ex-parte, but then set-aside in April 2022 and next session is scheduled for June 27th before which I would like to see what evidence she submitted to the court.

Also, her GWOP petition asked for relief to give her custody of the child to obtain US Passport for my daughter without my consent. I would like to obtain an official copy from court for this as well.

My advocate is not cooperative in these matters and I believe he is playing double game and compromised.

You can make application in family court for certified copy of affidavit of evidence filed by wife and  GWOP petition filed by her 

 

you should get said copies in a month time

- As per law, she is under obligation to supply one copy to the opposite party/you ,whatever she has filed before the court. 

- If you have not received the copy of the evidence filed by her , then you can mention to the court on the fixed date for the same. 

- Otherwise, you can apply for getting certified copy of the evidence /affidavit filed by her in the court. 

- Similarly , you can also get the copy of the petition & other documents which I have mentioned above. 

- If you are not satisfied with your lawyer then can replace him after engaging another one.

- However , if you are presently abroad , then you can give POA to any relative or nearest person for the same.

You can obtain the certified copies of all the documents and the copy of the petition and chief examination affidavit from by filing a copy application before the concerned court. 

If your advocate is not cooperating then either you can change the advocate or apply for the certified copies as party in person also. 

You can file an emergency petition along with the copy application so that you can get the copies expeditiously.

Believe on the advice of your advocate. But, if you have any doubt, my advice is to change your advocate and seek his advice. In the instant case, you may obtain certified copies of the document you required by inspecting the file through your advocate. You have to apply on a prescribed form affixing necessary stamp fee for obtaining certified copies and seek permission on your written application for inspecting judicial record from the Hon'ble Court, where the matter is pending.
