• Adding child’s surname AND mother’s surname on child’s Mumbai issued birth certificate

Hello,

Can anyone advise us on how to add Surname 
(1) To the child’s name AND 
(1) To the mother’s name, on the child’s Mumbai issued Birth Certificate (to match existing passports).
We are currently OUTSIDE India. So any information on useful links or authorised companies who can assist with the same online will be appreciated.

unless the biological father of the child gives consent the mother can not change the name or surname of the child or the name of his father.

If you want to add surname or even change the spelling of your name, you may have to follow the process of change of name 

You may have to first prepare an affidavit giving reasons to change the existing name in the form of an affirmation, get it notarised, after which you may have to get it published in two local newspapers. 

Once it is done you may get the changed names published in the government gazette publication.

Then you can attach the copy of the gazette publication to all the applications wherever you may submit to concerned authorities seeking to change the existing name to the proposed name  

You do not have to take the assistance of anyone if you are prudent to do this task by yourself.

Whether you want to add the surname or rectify the spelling of your name, the procedure to be followed is by complying with the procedures meant for change of name as suggested in my previous post.

- You can change or correct or add surname of your child after moving an application before the office of the Birth registrar from where this certificate as issued. 

- However, before submitting the application , you have to execute an affidavit after declaring that the name of child and he will be known by the correct name for future purposes. 

- Further, submit this information as public notice in two leading newspapers of the area of residence . 

- However, there may be requirement for offical gazette publication , but it is not mandatory .

If there is already a name mentioned it cant be Alretered unless a clerical error is there. You can make changes in gazette notification for the same and add it

Following is the procedure under Births and Death Registration Act for rectification/addition of name in birth certificate …

  1. Submit an application to the Executive Magistrate/Tahsildar/MRO for direction to municipal authority for adding required surname.
  2. A notarized joint affidavit by father and mother praying for addition of surname. Birth certificate as it is now.
  3. Proof of document with surname.
  4. Executive Magistrate/Tahsildar will give direction to municipal authority for carrying necessary changes.
  5. Take that direction to municipal authority and submit of municipal authority with covering application.   
  6. You will get required birth certificate with changes on payment of Rs. 50/- fee to municipal 
  7. Presence of at least one parent is Such application  cannot be filed through GPA/SPA. The other parent can appear through GPA issued  to parent present in India.

Dear Client,

Obtain 'Birth Certificate Update/correction Form' the municipal corporation office or gram panchayat where your child took birth. Obtain an affidavit from local notary and approach the officer regarding change of name in the birth certificate. Make an affidavit on a non-judicial stamp paper of minimal and mention the reason of name change. Fill the correction form and submit it to the municipal corporation along with affidavit or certified copy with judge original signature. After the completion of the application process, publish the advertisement in the local newspaper and your state official Gazette publication.
