• Landlord refusing to return deposit

Hello, 

I live in Chennai in a flat since 2019. I have a lease agreement which ran for one year and expired end of 2019. It wasn't renewed.

Part of this lease agreement was that the monthly rent would be increased by 10% every year.

My landlord however never increased the rent and kept accepting my regular monthly payments.

I was asked to vacate now. I paid a deposit of 96k. The landlord now says that he would retroactively charge the increased monthly payments and is refusing to return any money from the deposit.

I sincerely need some guidance as to what my options are.

You first issue a legal notice demanding the return of the deposit amount. 

Let the landlord give any excuse,  if he fails to comply or return the amount you can file a suit for recovery of your deposit amount.

If it has stated in the agreement that there would be increase and the same was agreed by you the same is payable by you. It's your liability

  • For increasing 10% rent every year had he renewed the lease agreement.
  • In the lease agreement it's mentioned 10%rent increase than you can't deny it.

- If there is no clause in the lease agreement for the deduction & adjustment of security amount , then the landlord is bound to refund the said amount to you. 

- You can send a demand legal notice to the landlord for seeking refund of security amount , if not refunded then file a Recovery suit before the Court.
