• Marriage license

I am Canadian and residing in Canada went to India in January of 2021 and got Married on February 07 to a girl in India, Ram Rai Pur, Nawanshar. We have a marriage certificate but no license. For immigration purposes we need a marriage license. What is the process to obtain a marriage license?

You have to get married under provisions of special marriage act 

 

2) marriage between Indian and foreigner has to be registered under provisions of special marriage act 

 

3) 30 days notice of intended marriage has to be given 

 

4) after period of 30 days marriage can be solemnised and registered before marriage registrar 

 

5) kindly clarify as to how your marriage was solemnised and marriage certificate issued

Marriage license is a new word and unheard of it. 

The marriage certificate is the only document to prove and establish the marriage between the spouses .

The marriage certificate issued by the competent marriage registrar or Marriage Officer of the concerned registrar's office or an authorised Marriage Officer appointed by concerned government shall be the only document to prove the marriage between the parties to the marriage.

Who had asked you to obtain the marriage license and from where?

If you have a marriage certificate issued by a competent authority appointed by government, that is more than sufficient.

The marriage certificate is an official declaration that states that two people are married. In India, Marriages can be registered either under the Hindu Marriage Act, 1955 or under the Special Marriage Act, 1954. For both types of marriages, a marriage certificate is legitimate proof that a couple is married.

If your marriage certificate was issued by a church which solemnised the marriage then it is pertinent that you may have to visit the marriage registrar within the jurisdiction where your marriage was solemnised and register the same under Christian marriage act, apply for marriage certificate after it has been duly registered and proceed to complete the necessary visa formalities

- If your marriage was solemnized as per Christian customs , then you will have to registered your marriage under the Special Marriage Act from the office of Registrar. 

- Further for marriage registration and getting the Licence/certificate , 30 days stay in India is needed , however the person who is staying in India can apply in the absence of  the spouse who is residing abroad. 

- Further , you can apply online as well , and in some states there is facility through VC . 

- Further the following documents required for marriage registration in Nawanshar :

  1. Birth certificates (for age proof)
  2. A valid visa of more than 30 days for the foreign national
  3. A single-status affidavit signed by both parties. In case one of the parties has married previously, the Divorce Decree (for divorcees) or Certificate of Death (for widowed) is necessary.
  4. Address proof and passport size photographs
  5. Adequate documentary evidence of 30-day residence in India
  6. A ‘no-objection’ letter from the US Embassy or Consulate, 
  7. Three witnesses are required, who have to provide passport sized photographs, as well as identification and proof of address

- 30 days residency requirement means that either the bride or the groom has to be living in India for at least 30 days prior to applying to the local registry office to get married.

- For foreigners, this is evidenced by a certificate from the local police station.

- If no objections to the marriage are received within 30 days of the application, a civil ceremony at the registry office will take place

- The marriage certificate/licence is usually issued a couple of weeks after the wedding

A marriage license is a document issued, either by a religious organization or state authority, authorizing a couple to marry, it is done before the marriage.  And for the immigration process marriage certificate is enough as the evidence of marriage.

For immigration purposes we need a marriage license ?
There is nothing called marriage license. nobody needs a license to marry.

For immigration purposes you need a marriage Certificate.
I guess you have a priest marriage certificate which is valid only in India.
For abroad, you have to get marriage certificate using this priest marriage certificate from Marriage Registrar office.

No need to be in India for getting marriage Certificate from Marriage Registrar office.
