• Payment taken, no service

I paid Rs 50,000 by online bank transfer to a document finder in Delhi to obtain certified copies of documents relating to the flat I inherited from my mother.

Since January of this year he has sent me nothing. He does not reply any more to my email messages or answer calls.

As I am working in Spain maybe he feels I cannot take action against him 

I feel upset because I do not now believe he intends to provide a service for the money he took 

What can I do given that I cannot easily visit India?

  1. A detailed complaint can addressed to Delhi Police online. Giving all particulars his like phone number, address, proof of transfer of money. Police will certainly take action against him.
  2. A GPA attested by Indian Consulate can be given to your friend/relative in India to file complaint against him. He can do all formalities required by law from you. He can file the complaint in the court of Magistrate for cheating under Section 420.
  3. If he is acting as real estate agent you can also complaint online to RERA Authority, Delhi. In all probabilities he is doing business without registration with RERA

You issue a legal notice to the said advocate either through another lawyer or by yourself demanding either the task to be completed or return of the amount paid after deducting the expenses that he incurred so far in this regard.

Whenever you realise that you have been hit by a fraud via a digital transaction, you must first save screenshots of any SMS, email, fraudulent website, UPI handle or mobile number through which the fraud occurred. In case the mode of payment is any e-commerce platform a screenshot of the merchant’s web page should be saved. Customers should also note down any transaction ID numbers, in any of the above instances.

Your first stop is the bank, NBFC or payment platform you were using when defrauded. In the case of UPI, you should report the fraud to both their bank and the payment company whether it is Google Pay, Paytm, PhonePe or others. Here you can simply file the complaint with the card issuing bank via online method. Once the complaint has been registered with the concerned company, you should file a first information report or FIR with the local cyber-crime police department. The Ministry of Home Affairs has a specific portal related to cyber-crimes, listing the relevant cyber-crime police stations across states.
