• Need legal advice

Last year I posted one question about my situation and asked for advice here.

I am working in the U.S. for the last 20 years and have some properties in India.
I gave power of attorney to my elder brother to take care of my properties and collect rents.

He used to send me statements showing less money collected but in turn, they used to collect more money from my tenants.
Due to my elderly love and respect for my brother I never used to doubt the credibility of the statements.
They used to collect more money and show more expenses and in turn, he used to make money and saved in crores.

He passed away last year April due to Covid and I have to take care of my properties and found out the truth.

I got the advice in this forum that I can go ahead and sue their kids (2 daughters and a son) and wife.
I went to India and contacted the lawyers and they asked me to first try to settle it peacefully with their kids and wife if not I can sue the family later.

I met with my brother's family ( 2 Daughters, Son, and a Wife).
Fortunately, my brother's Wife and Son agreed to repay my security deposits of my apartments and also will pay 25% of my money.

Unfortunately, the daughters are not interested to pay me and they involved my own brother-in-law Rajesh who is Superintendent in Customs Audit.

Mr. Rajesh is a very corrupt officer and is involved in illegal activities (black money, gold smuggling, etc.)
He is troubling me in every aspect possible. There are four to six people who owe me money. This Rajesh called them and asked them not to pay my money.
He has connections to other Senior officers and commissioners and he is very arrogant.
He stole my rental diaries, important documents, and other account information just to take that money.

I am looking for some advice as to how I can take care of this Rajesh.
Can I file any case to get rid of him or how can I report to concerned officers who can take action against him.
I sent complaints about him on a few websites and it's not progressing ahead.
If anyone has dealt with such corrupt officers and has some advice that will be helpful, please let me know. Thanks

File a case against him before the CBI and ENFORCEMENT DIRECTORATE. You should do this by detailing all things he has done.

It is stated that said Mr. Rajesh is a very corrupt officer and is involved in illegal activities (black money, gold smuggling, etc.). Explore the possibility of making complaint against him with proof of his illegal activities. It is the official power with which  he is harassing you, deprive him of that power.

Check the movable and immovable properties purchased by him or his family members. There are strict for such transactions by Central Government employees. They need to take prior permission and account for funds. There are many ways to trap a corrupt government official.

You can take action against the corrupt officer only if he has personally harmed you or obstructed you or harassed you or created nuisance to you directly.

Without any base you cannot file any case against him hence you may concentrate on your case alone.

If he has instructed your other debtors to not pay the money due to you from them, you can take legal action against them without bothering about your brother in law's indirect obstructions.

You can submit an application to the information officer to know the status of your complaint on this through RTI Act.

Wait for one month for a reply, if you don't get any reply then you can send a first appeal against the information officer seeking the desired information.

After obtaining the information through RTI act, you can decide whether to proceed legally on this or not depending on the information.
