• Anticipatory Bail to Bail process

I have obtained anticipatory bail for a false 498a and the AB was granted on Jan 31st and required to appear before the magistrate with 2 sureties before April 30th. I have arrived in India a week ago and now heading to appear in court before the magistrate to produce the sureties and pay the required money for bail and get it tomorrow.

My advocate has not been very forthcoming and told me that the procedure to get bail is a day long process even after appearing in court with the sureities and required paperwork plus photos. I am not sure why this is a day long process and want to find out if this is accurate.

It take full day to complete the formality of furnishing sureties and obtaining approval of Court. Bail is granted to you, your case is no more a priority. You need to submit surety fomes, bail bonds and personal bonds in the first session. Papers will be checked by CMO and put before the Court after lunch, that will be around 3 pm. Judge will verify papers and ascertain from severities if they undertake to produce you in Court whenever required. By that time it will be around 5 pm.

It takes one day to get the order of the bail if granted by the court and another day to comply with the sureties Or cash bail as directed by the court
