• Change of passport details

Cyber criminals have digital copy of the front page of my passport that contain the details of my full name, photo,address, date of birth, passport Id, signature. I want to change my passport, but the rules say we can change it only if passport is expired/lost/stolen/damaged. How can I change it, there is no security that cyber criminals have digital copy and can misuse it

When the Passport Act was enacted in 1967, there was no cybercrime, no possibility of  identity theft. All the possibilities arose subsequent to enactment of the Act. Acta are flexible to accommodate such development and provides solutions. Approach High Court in writ seeking direction of  passport office to provide new passport, you have valid ground.

You cannot change your passport as it is not stolen or lost or damaged 

 

2) you can approach passport office personally fill in form for surrender of your passport 

 

3) obtain surrender certificate from passport office

You better give a complaint to the police that you have lost your passport  and to register the complaint.

On the basis of complaint you can submit an application for reissue of passport.

Even though you have actually not lost the passport, in order to protect yourself from the possible misuse of your passport which you apprehend, you may have to take some steps in this manner or else to give a complaint against the suspected criminals who you presume to misuse the same for any wrongful gains.

                 Section 464, 477A, of IPC and section 12 of Passport Act , 1967 is applicable.Whoever commits forgery shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both. Imprisonment for 2 years, or fine, or both.For a basic, first offense of passport fraud, such as lying on a passport application, you can be fined and sentenced to up to ten years in prison. If the fraud involves trafficking in narcotics, the penalty increases to up to 20 years in prison.This can lead to gaining access to the original holder's bank account or using their identity to set up new accounts, through which illegal funds can be laundered. More dangerously however, the passport can be used to travel under a fake, "clean" identity.Scanned copy of your passport will contain your details like date and place of birth, your full name etc. However they cannot make use of those details for anything for fraud etc. To be safe you may bring this matter to the attention of police.
