• How to cancel the POA

Sir/Madam, how do I cancel a POA that I had made for a person from whom I wish to revoke the given power, as the person did not carry out the responsibility given to him through the POA deed. Thank you

A PoA can be cancelled by a registered declaration by the person who made the PoA. The document should declare that tge PoA has been cancelled and it will no longer hold any force.

Dear Client,

The donor of the power of attorney will have to get a registered cancellation deed (registered from the office of the respective sub-registrar). After that, the principal has to give the holder of the power of attorney the registered cancellation deed, informing him or her of the cancellation.

You can revoke the POA by executing a Revocation of the Power of Attorney. The Revocation Deed must be drafted on a Stamp paper of due value which shall mention the correct details of the Principal, the Attorney, the details regarding the previous Power of Attorney, the cancellation date, and registration details including the place, name, and the office of the Sub-Registrar. A written notice informing the Attorney of the cancellation should also be sent.

You can issue a legal notice to the power agent communicating your decision to cancel the power deed given to him for the reasons you rely upon and subsequently you issue a newspaper publication to this effect.

After that you can approach the concerned registrar office with an applicator enclosing the legal notice and the paper publication with a request to not entertain any transaction that the power agent would be trying to do with the support of the said registered POA deed. 

Simultaneously you can execute a cancellation deed cancelling the POA deed given to him.
