Property management company has not paid rent for last 3 months. They are not answering calls or emails and are not vacating the apartment even after giving notice to vacate in mid Dec.
Apartment is in Bangalore. 5 months rent was paid was deposit. Agreement is till mid March. Can I sent a legal notice to vacate now as they have not paid rent for 3 months now and I had given them notice to vacate on mid Dec.

Take steps to get them/their client evicted from your flat.
The legal notice should suffice the purpose for now.
If they do not respond to your legal notice, file an eviction suit against them.
You can file a suit for eviction for willful default in rental payment.
The documentary evidences namely legal notice and evidence of not remitting the monthly rental amount would be sufficient to file an eviction suit.
Legal notice can be given only once. if there was no response then you may have to file an eviction suit as a consequence.
- If the said company is not paying rent , then the landlord is entitled to take possession of the tenanted premises.
- You can send a legal notice for the termination of the tenancy to the said company.
- Further, if not vacate , then you can file an eviction petition for getting possession and arrear of the rent.
Hi, you can issue legal Notice under 106 of the Transfer of Property Act. Ask them to vacate the schedule property and if they failed to vacate the same then you can file a suit.
