• Boyfriend promised to marry and now refusing

My boyfriend promised to marry me before making physical relationship. After few months I got to know that he lied to me about his age, his salary, his education, etc. He lied to me about his family status as well. I have all the whatsapp chats as evidence. These things did not matter to me but I still confronted him as I was hurt, especially about his age. He then told me that he wouldn’t marry me. Upon my constant request, he agreed. Things were normal then. I even had abortion twice for which I have all the hospital bills, transaction details, etc. Now 6 months ago I got to know that while he was with me he was also with another woman throughout. When confronted again, he apologised a lot. But I just threatened him about the money (3.45 lakhs) that I had given him while we were together. After transferring the amount he called me to tell me that he had realised his mistake and he wanted to meet my parents to discuss our marriage. I took some time but eventually believed him and focused on the positive. Our parents met and discussed everything. I had given him 3 lakhs again within these 6 months because he wanted a bike. Now last week he called me to give me a very lame reason and told me that he won’t be able to get married to me. I got furious and asked all my money back. Initially he hesitated but I threatened him to take legal action against him so that is why he transferred all the amount. Now, after knowing his reality, I don’t want to get married to him at all. But I want to know what charges can I levy upon him as he has wasted 2.5 years of my life where I was getting really good proposals but he made me decline all of them. He has cheated not only me but many girls and now my parents and I want to really see him getting punished for his bad deeds. Also, he is addicted to drugs like hash and weed.

You entered into a physical relationship with him on the pretext of marriage. He promised to marry you but has deceived you and because of this relationship you have suffered a lot.

Therefore charges of rape cheating and criminal breach of trust can be filed as your consent was no consent at all.

You can very well give a complaint against him withe police in your locality.

He has committed the offences of cheating, rape and intimidation  besides other offences like breach of trust etc.

You draft a complaint neatly describing the events in chronological order and wherever possible you can attach the copies (not original) namely about abortion and other events like the money that you had transferred to him in good faith, etc., as documentary evidences supporting your complaint.

The police may register FIR under sections 376, 406, 417, 420, 506 and 509 IPC too.

Once the FIR is registered then his life will become miserable and he may beg to you to withdraw the complaint.

You may not forgive him because he will play the same old drama again to hit you sentimentally and may go scotfree after that to spoil the life of another girl/woman  with flirting habits. 

You may not show any mercy to him once you have decided to lodge the complaint against him.

You can very well file a case against the person who cheated you u/s 376 r/w 417 which amounts to rape by deceiving in guise of other relationships and it should be substantiated with proper and sufficient evidences

Yes, having sexual relationship on the promise of marriage and refusing to marry would amount to rape offence. 

There are various judgments to ascertain this. 

The complaint should be lodged in such a manner that the commission of cheating,  breach of trust,  sexual relationship with false promise to marry should be properly made out in the complaint. 

Don't mention about the false age, because that's not an offence.

Dear client, 

Trying to charge him with Section 376 may be possible as long as you can show that you were not aware of his real nature because of everything he lied to you about. However, it will be up to the court to decide whether the lies he made up with regard to his education, personal details, etc. can count as him not revealing his true identity to you. Since Section 376 is a very serious charge, the court will look into the matter very seriously. Him lying to you about such things may not constitute such a charge, but it will be up to the court to decide that.
