Question on LOC removal
Hi Last year when I was in US my ex wife had filled dowry case in india and due to which there was an LOC issued against me. After that we had divorced legally and matter was settled, she had filled withdrawn of dowry case last year. However when I travlled back to INDIA I was detained in immigration ( as the LOC still existed), I was released after they getting to know the case has been sent to closeure. MY case has been sent to closure and it is in migistrate court still and withdrawn of LOC has been issued. It has be almost one year since LOC was opened 1) Will I be able to travel back to US with LOC closure reference number, and case closed details from the judge If not what is the right procedure to be followed for me to travel back ASAP

- You need to obtain close of loc from trial Court. getting closer by police and investigating agency is lengthy process.
- Obtain multiple certified copies of cancellation of loc and submit the same to IO concerned and send a copy to nodal office at Deputy Director, Bureau of Immigration, East Block-VIII, R.K. Puram, New Dehli-110066. Confirm that the same is removed.
- Obtain confirmation of cancellation from Bureau of Immigration. Even after that you may be stopped from leaving abroad. The immigration officer will confirm with the out ward number from to originator.
If an FIR was filed against you under vertain sections then it has to be quashed by the high court. Both the parties or their representatives have to be present and give their statements before the court that they wish to withdraw all cases filed against each other. Girls file false cases but after getting the money don't care. You have to follow procedure and make sure that all cases against you are withdrawn otherwise you wil face problems in the future.
Until and unless you have the certified copy of the orders passed by the magistrate dismissing the case on the basis of the withdrawal petition filed by her, you may not be able to prove this fact before the immigration authorities.
In fact the concerned police have to give instructions of withdrawal of LOC to the immigration authorities after which they will upload the information by which you will not be stopped at airport in future due to this.
You may obtain the certified copy of the orders passed by the judicial magistrate in this regard so that you can produce the same at the airport if in case you are stopped once again.
