• My in-laws haraassment

My husband and myself r facing money harassment from my in laws . Since we have married in register office without parents consent they have been harassing me and my husband mentally . At present my in-laws are staying in the house owned by my husband . We r staying in same house in a different portion. But we have been facing this harassment of dowry and apart from this my in-laws filed a case in family court to pay 20lakhs as they invested during house construction (which is not true as the house owned by my husband and he has taken home loan and paying EMI every month.)

How can we get rid of their mental torture and ask them to leave our house.

My husband is not the only son .. my in-laws have elder son as well but they are not willing to stay with him.

Your husband can issue legal notice to parents to vacate portion of house in their possession 

 

if they refuse file suit for eviction

If you  in laws are constantly torturing you demanding money and other issues, you may lodge a criminal complaint against them with the local police for dowry demand and harassment as well as you may file a DV case agaisnt them seeking protection from them and also an restrain order to restrain them from interfering in your affairs as well as to restrain them from torturing you.

You may have to take your husband into confidence before intending to file such cases against his parents so that he may support your cause.

If they have filed a money recovery suit against your husband, he has to challenge the same properly with the support of documentary evidences in his possession.

He may also plan to suit for eviction against them to evict them from his own property.

You can file eviction suit against your in-laws. As well as you can file domestic violence complaint against them too. They can't leave at your place without your consent

Dear Mam,

1.The provisions of law dealing with the harassment of a woman by her in-laws are Sections 498- A, 509, 304-B, 306, of the Indian Penal(IPC), the Domestic Violence Act, 2005 and Dowry Prohibition Act, 1961.

2. you can file complaint against your in laws under these provisions in order to prevent harassment from them.

I am forwarding the law against harassment of wife by husband’s family. You can file criminal case under Section 498A if there is demands of dowry  by in laws. Complaint can also be filed against only in laws excluding husband. Take husband in to confidence. it good to keep him on your side. Only the threat of punishment can prevent them from harassing you.

Depending on the full facts of your case you can lodge a complaint with the police / protection officer under section 12 of Domestic Violence Act.

- As per law they are not allowed to interfere in the matrimonial relation of their son and daughter in law. 

- If they are creating problem then you can file a compliant against them under the Domestic Violence Act for harassment and demand of dowry 

- Further, if the property is in the name of your husband and on loan then they cannot take any advantage from your husband even they have invested any amount . 

- Further, if they continuing to creating rift between you and your husband , then lodge a complaint against his parent after mentioning that they are trying to misguide your husband against you , as he has marry against their wishes.

They can bribe police but not the Court. File the case in the Court of Magistrate engaging and Advocate  as police is not willing to take complaint under the stated provisions of law. Court will order police to register FIR,  investigate, produce accused in court and file charge sheet. After trial Court will punish the accused.

The DV case can be filed directly before the judicial magistrate court and not with the police station.

If the local police is not accepting your complaint and are appearing to be on the side of your in laws alone, then you can approach the higher police officer of your city/district with a similar complaint and a request to direct the concerned police officer to take action on your complaint, if this step is also not effective you may approach jurisdictional judicial magistrate's court with a petition under section 156 (3) cr.p.c. seeking direction to the concerned police station to take legal action on the complaint pending before them.
