What is the best option to have same date of birth across all IDs?

** Summary of Date of Births **

1986 - on the School Leaving Certificate and Passport
1988 - on the Birth Certificate
1989 - on th Addhar, PANC, and Voter card


Why different Date of Births?

She was born in a village where people never valued the importance of legal documentation so no one bothered for official birth registration nor they cared for putting in correct or accurate dates in all IDs.
So due to the carelessness and igorance, she ended growing up having different Date of births in different IDs.

School Leaving Certificate & Passport --> Birth year is 1986​
- Because her mother had messed up the birth date during school admission
- So the School Leavning certificate shows her as born in 24/12/1986
- Now the school has refused to update this.

- When she applied for the passport in 2014, she used her School leaving certificate as primary DOB document. Because she could not obtain a birth certificate from her village.
- So her passport contains the same Date of Birth as the School Leaving certificate.

Aadhar Card, PAN Card, Voter ID --> Birth year is 1989​
 - When her parents applied for her VOTER ID, they told the operator that her birth year was 1989
- The operator entered the DOB as 24/12/1989 (without asking for any ID)
 - So she received her voter ID with DOB.

 - Her family used the same Voter ID details to obtain the PAN Card.
 - And the Aadhar Card was also obtained with the same details.
 - So her Aadhar, PAN and Voter ID carries the same date of birth

 - NOTE: The Aadhar Card department has informed that they can not change the Aadhar Card Date of birth.

Birth Certificate -->Birth year is 1988​
 - Recently she was required to present the birth certificate due to land ownership transfer.
 - So one of her family member bribed/used contact to get the Birth Certificate copy from the Panchayat
And that came out as 1988.

QUESTION IS

(1) Can She change DOB in the Passport to match with her Birth Certificate? (She got her passport in 2014)

(2) If the above is not possible then Can she update the DOB on the Birth Certificate to match with passport?

1) passport office would not change date of birth in passport as school leaving certificate reflects different birth date 

 

2) obtain court orders for change of date of birth in school leaving certificate and passport based on birth certificate 

 

3) then use said court order to change date of birth in Aadhar card

Dear Sir/Ma'am,

1. You can change your Date of Birth in your passport. To change the date of birth in the passport, you have to apply for a “Re-issue” of the passport and get the specified change done in the personal particulars.

2. The process of change in date of birth in the passport in India is fairly simple. You need to specify your correct date of birth in the application form and furnish proof of date of birth.

3. The documents which serve as valid proof of date of birth are:

  • Birth Certificate issued by a municipal authority or the office of the Registrar of Births and Deaths or other designated authority. In the case of applicants born on or after 26th January 1989, it is mandatory to furnish this proof.
  • An affidavit from Magistrate or Notary confirming the date of birth in case of the illiterate or semi-illiterate applicant.

4. On submitting the correct documents, the authorities will change the date of birth in the passport in India and issue you a new passport.

Hi, she can file a suit for  declaration that her birth date should be declared as per Birth Certificate and  she need to change the records in all other documents and further, she need to make parties all other authorities in the suit.

As per Judgment of Kerala HC application for change of date of birth in passport would not be allowed after period of 5 years of issue of passport if applicant was major at time of issue of passport

1. She can apply for reissue of passport  with correct dte of birth by producing the original date of birth certificate issued by the competent authority.

If the passport authorities refuse to entertain the same, she may have to approach court with a suit for declaration to declare her correct date of birth as per the birth certificate and may have to convince court the reasons for different dates of birth appearing in her different documents. 

Based on the court order she can change the date of birth in the passport, aadhar card, PAN card and other related documents except the school certificate.

The school certificate cannot be changed until and unless you get a direction from the court to the authorized concerned to amend the date of birth as per the birth certificate. 

2. Don't do such gimmicks, it is also an illegal act, therefore if you are not honest and serious about your relief, you may have to suffer the problem forever.

If the passport authorities still are not entertaining the application, you may follow the legal procedures as advised

- As per law, one cannot change or correct the DOB in the academic qualification certificate including SLC after 2 years from passing.

- Hence she cannot change in School leaving certificate and passport 

- But , she can correct the DOB in all the documents mentioned by you after submitting the copy of the SLC and passport.

Dear Sir/Ma'am

If the passport was issued in 2014, you could come across some problems for changing the date of birth because renewal with change of DoB applications are usually not entertained if  a period of 5 years has elapsed since it was issued.

However the other documents like Aadhaar, PAN and voting card can be rectified without a problem.
