You can get married to her through special marriage Act.
Since you both are foreign citizens, you may not be able to register the marriage in India even though you have an OCI card.
Even under the provisions of Foreign marriage act;
A marriage between parties one of whom at least is a citizen of India may be solemnized under this Act by or before a Marriage Officer in a foreign country,
Looking into the increasing trend of people getting married abroad or marrying with NRI or foreigner; Foreign Marriage Act was passed in the year 1969 to provide provisions for marriages of Indian citizens who are outside the territories of India.
The main purpose of establishing this act was that in India, the people protected and governed by these laws can select a martial law based on their religion and community-specific marriage laws or can choose to follow the common laws of civil marriages in India which apply to the population in general.
Since you are Hindu and she is Muslim and both don’t want to change their religions get marriages under provisions of special marriage act
2) you need to stay in india for period of 30 days before applying for marriage need following documents
3) passport of both parties
4) birth certificate of both parties
5) certificate of single status
6) passport size photos of both parties
7) 30 days notice of intended marriage has to be given to marriage registrar
You can marry her in India but you have to live here for at least 30 days. After that you may apply for marriage before a marriage registrar and he will perform the official procedure and give you a certificate.
Dear Sir
Since neither of you have Indian citizenship, it would be easier to conducted the legal officiating of the marriage in either Moroccan or Australia and the ceremonies and festivities can still easily be conducted in India.
However if you are adamant of getting the actual wedding done in India, you can come around 2-3 months early and will be eligible to conduct the marriage in India under Special Marriage Act without either of you having to change your religion or customs.
Thank you
