• Plot of Land in Andhra Pradesh to be gifted to sister by brother. Donor is in Pune, Maharastra.

Mr. X has a plot of land in Andhra Pradesh. He wants to gift the property to his sister who lives in Andhra Pradesh. Mr. X currently lives in Pune, Maharastra and the property documents are with Mr. X. During the pandemic situation, as Mr. X does not want to travel to Andhra Pradesh to register the gift deed, etc.. 

What are the options Mr. X has in order to facilitate this gift to his sister from Pune itself via online or local registration methods or any others - and empower his sister to sell or enjoy the property as she likes?

X can execute specific POA in favour of family member to execute gift deed in favour of sister 

 

POA should be registered in Pune

A gift deed should be made and executed by Mr.X and that way the property can be transferred.

His sister can appoint a PoA in Pune who can represent her and thus the transaction can be complete.

You can appoint your sister as Agent or Attorney to act on your behalf through POA as Donor by executing the registered Gift Deed in the jurisdictional Sub Registrar's Office. Your sister will sign against Donor's name, on your behalf as well as she will receive the gift as Donee, by signing the Deed. In other words your sister can execute the Gift Deed both as Donor and Donee.

Dear Sir,

1. Normally it is required for you Mr X to come to AP to register the gift deed in the sub-registrar's office. Gift deed registration online is not possible right now however through gift deed online could be possible by submitting draft online and getting approval from sub -registrar but on final final execution you have to be present before the Sub-registrar.

2. However, there are several websites online that register the gift deed online after payment of a nominal fee.

Dear Sir,

It is suggested that you give special power of attorney to the sister to enjoy the property for time being but when the things get normalised, you may travel to AP and get the gift deed done.

- If that property is self acquired property of Mr X , then he has right to gift the same any one as per his own wish and none having right to claim . 

- Further, if the property is based in A.P. , then gift deed should be registered in the same jurisdiction 

- If Mr X is unable to travel due to the said reasons , then he can execute a GPA in favour of any relative or nearest one to execute the gift deed on behalf of Mr X

- There is no facility of online mode for registration of any deed.

Mr. X can transfer his property to his sister by executing a registered gift deed.

If he is not able to travel to his sister's place to transfer the property situated in that place from Pune, then he may execute a registered GPA deed in favor of any close relative authorising him/her to complete the said task on his behalf. 

There is no provision in law to   execute the registered document online without appearing before the registrar concerned either by himself in person or represented by his power of attorney agent.

1. Mr.X can execute a General Power of Attorney (GPA) in favour of any of his blood relatives to authorise him to execute the gift deed for and on his behalf in favour of his sister.

2. GPA has to be registered.
